Book excerpt: Según el «dogma de la nulidad», una vez que una norma jurídica es considerada nula deben eliminarse todos los efectos que esa regla ha producido. En tanto el derecho o el sistema jurídico no pueden tolerar en su interior la coexistencia de normas contradictorias, resulta lógico que cualquier antinomia deba ser rápidamente eliminada, para de esta forma preservar la coherencia general del sistema. Asistimos, sin embargo, a una etapa de nuestro desarrollo jurídico en que, mediante diversos instrumentos, a veces establecidos de manera explícita por la ley y otras veces de no tan clara derivación de ella, intentamos escapar de aquellos efectos restitutorios de la nulidad. La explicación teórica y práctica de esta huida, no obstante, no ha gozado de la debida claridad, lo cual se traduce en que hoy en día no se puede predecir con certeza cuándo a una declaración de nulidad le seguirá un completo restablecimiento de las situaciones jurídicas de los afectados y cuándo ello no será así. Utilizando como casos de estudio los procesos de nulidad contra leyes, reglamentos, actos urbanísticos y actos comunitarios, se identifican en el presente trabajo los problemas comunes a que da lugar la relación entre nulidad y restablecimiento en esos órdenes. Del mismo modo, se exhiben las principales objeciones de mantener aquella indefinición teórica, y los perjuicios que puede originar un casuismo exagerado o la apelación indiscriminada a principios jurídicos como forma de modulación de aquel restablecimiento.
