Book Freedom of Information Law and Good Governance

Download or read book Freedom of Information Law and Good Governance written by Emmanuel Saffa Abdulai and published by Springer Nature. This book was released on 2021-10-15 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that Sierra Leone’s ten-year civil conflict demonstrates the criticality of freedom of information (FOI) as a facet of good governance where corruption thrives, spanning both public and private sectors, if Sierra Leone’s continued security and stability are to be ensured. It argues that it was the absence of an anti-corruption tool like FOI and its attendants, transparency, and accountability, in governance generally, and in the area of the extractive industry in particular, that lead to other social phenomena which directly sparked the war. It proffers that for the continued consolidation of peace, security, stability and development in Sierra Leone, transparency and accountability must be ensured by protecting and implementing the demand driven anti-graft FOI. Straddling the disciplines of law, political science, public policy, and history, the book’s major premise is that it was the absence of FOI in the area of governance and the extractive industry, which enabled politicians, civil servants and the politically connected to ransom and exploit Sierra Leone’s mineral resources for their own profit with impunity, a state of affairs which led to underdevelopment, state collapse and an embittered civil populace especially the youth. The book postulates that as such any attempt to ensure long-term peace in Sierra Leone, should seek to avoid replicating the conditions that gave rise to that gruesome conflict- elites expropriation of national resources through endemic graft. The book proposes the comprehensive and effective implementation of the Right to Information Act 2013.

Book Troubling Transparency

Download or read book Troubling Transparency written by David E. Pozen and published by Columbia University Press. This book was released on 2018-08-07 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today, transparency is a widely heralded value, and the U.S. Freedom of Information Act (FOIA) is often held up as one of the transparency movement’s canonical achievements. Yet while many view the law as a powerful tool for journalists, activists, and ordinary citizens to pursue the public good, FOIA is beset by massive backlogs, and corporations and the powerful have become adept at using it for their own interests. Close observers of laws like FOIA have begun to question whether these laws interfere with good governance, display a deleterious anti-public-sector bias, or are otherwise inadequate for the twenty-first century’s challenges. Troubling Transparency brings together leading scholars from different disciplines to analyze freedom of information policies in the United States and abroad—how they are working, how they are failing, and how they might be improved. Contributors investigate the creation of FOIA; its day-to-day uses and limitations for the news media and for corporate and citizen requesters; its impact on government agencies; its global influence; recent alternatives to the FOIA model raised by the emergence of “open data” and other approaches to transparency; and the theoretical underpinnings of FOIA and the right to know. In addition to examining the mixed legacy and effectiveness of FOIA, contributors debate how best to move forward to improve access to information and government functioning. Neither romanticizing FOIA nor downplaying its real and symbolic achievements, Troubling Transparency is a timely and comprehensive consideration of laws such as FOIA and the larger project of open government, with wide-ranging lessons for journalism, law, government, and civil society.

Book The Laws of Transparency in Action

Download or read book The Laws of Transparency in Action written by Dacian C. Dragos and published by Springer. This book was released on 2018-07-20 with total page 676 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the issue of free access to information as part of the openness and transparency principles. The free access to public information has become one of the most hotly contested aspects of contemporary government and public administration. Many countries in Europe have well-established Freedom of Information laws (FOIAs), while others have adopted them more recently. The problems that occur in the implementation of FOIAs are different due to the legal and institutional context; nevertheless, patterns of best practices and malfunctioning are comparable. The book analyses in comparative and empirical perspective the respective main challenges. Whilst the existing literature focusses on the legal provisions, this book offers practical insights through 13 national profiles and the EU level, on how effective the legal provisions of FOIAs really prove to be.

Book excerpt: This volume contains articles examining freedom of information statutes, including those protecting government employees who expose official misconduct. Using United States laws as examples, the articles explore the relationship of these laws to administrative and constitutional theory in the United States. In addition, they demonstrate how varying conceptions of information illuminate the controversies in the application of these laws to the revolution in the electronic storage and retrieval of information. The articles allow the reader to speculate how the connection of these laws to liberal democratic theory explains their recent adoption in several countries and their international application.

Book Freedom of Information Law Practice and Procedure

Download or read book Freedom of Information Law Practice and Procedure written by President Aigbokhan Esq and published by . This book was released on 2021-01-24 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: Freedom of Information is an indispensible area of human life and the book emanates from a desire to help raise the level of awareness of all those connected with the right. A book that tries to x-ray issues touching on FOI in Nigeria must be regarded as a sacred document to be read and consulted when there is a doubt about a fundamental conception relating to FOI, accountability, open government and transparency. There is a dearth of materials on the subject matter of this book both globally and in Nigeria. The work is unique because it seeks to satisfy the procedural and substantive thirst of the researchers and practitioners. It has not been easy deciding which sub-topics to treat in this book, bearing in mind that many of those whom this book are directed will not be lawyers. In compiling a book of this specialty, the principal preliminary tasks lie in defining the scope of materials to be included and the approach to be adopted in relation to those materials. We have addressed the subject in a manner that provides a rounded, contextual explanation of Freedom of Information Act which goes beyond pure law and also adequately covers the field. There are thirteen chapters beginning with the history of Freedom of Information Act and sources of right to information. Chapter three seeks to answer the question whether right to information is a fundamental right. In chapter four, discussion focuses on enforcement procedure of right to information with particular reference to judicial review where request for information is denied. Defences to such an action occupy a central place in chapter five, while impact of right to privacy on access to information in Nigeria is examined in chapter six. Chapter seven gives an interpretative analysis of the Freedom of Information Act, 2011. The extent to which the Freedom of Information Act is germane in governance, ensuring open government and serving as anti-corruption tools is the subject matter of chapter eight with nexus to chapter nine where Freedom of Information under open government partnership is examined. The scope of chapter twelve is comparative analysis of the Freedom of Information laws in the United States, United Kingdom, South Africa, Bangladesh, Canada and Australia, with particular emphasis on transplantation of relevant principles and institutions in those countries into Nigeria. Salient concluding remarks bring the book to a close in chapter thirteen.

Book Freedom of Information and National Security

Download or read book Freedom of Information and National Security written by Amin Pashaye Amiri and published by Herbert Utz Verlag. This book was released on 2015-01-06 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: Protecting sensitive national security information is among a government’s most significant duties. However, this concept may be used to adversely limit the public’s right to access to government-held information. Therefore, striking a reasonable balance between these competing interests is of great importance for any society. How important to the creation of such a balance is effective judicial review of government decisions denying public access to information on national security grounds? How should judicial review of these decisions be conducted? “Freedom of Information and National Security: A Study of Judicial Review under U.S. Law” seeks to answer these questions. It offers proposals for the improvement of judicial review of public bodies’ decisions in the U.S. and provides suggestions for conducting effective judicial review in other countries.

Available in PDF, EPUB and Kindle. Book excerpt: Enacted in 2000 and in operation in the UK since 2005, the Freedom of Information (FOI) Act has revealed information which has generated calls for constitutional reform. A massive 'information jurisprudence' has developed through the decisions of the Information Commissioner, the Information Tribunal and the courts. Governments' responses to the war on terror have involved increased resort to claims of national security and accompanying secrecy, but these developments have to exist alongside demands for FOI and transparency. FOI has to balance access to and protection of personal information, and major amendments have been made to the Data Protection Act in order to balance the competing demands of transparency and privacy. This detailed discussion of FOI laws and personal data laws examines the historical development of secrecy, national security and government, and their modern context.
