In addition, the book contains a detailed analysis of United States constitutional law on cross-border access to public services, exploring the question whether the European Community can possibly learn from the American experience.

Book excerpt: For decades, the European legislators and the Court of Justice have extended the rights to free movement and cross-border welfare in the European Union (EU). Strong assumptions on the impact of these rules have been posed, by some held to lead to welfare migration and thus to be a fundamental challenge to the welfare state. However, studies of how these rules are implemented and what become the de-facto outcomes hereof remain scarce. We address this research gap, by examining domestic responses to and outcomes of dynamic EU rules. Based on a unique set of administrative data, we do so for all EU citizens residing in the universalistic, tax-financed welfare state of Denmark between 2002-2013. We find that domestic responses have been restrictive and outcomes limited.

The authors rephrase Gunnar Myrdal's questions in An American Dilemma with reference to Europe's current dual crisis - that of the established welfare statefacing a declining capacity to maintain equity, and that of the nation state unable to accommodate incremental ethnic diversity. They compare developments across the European Union with the contemporary US experience of poverty, race, and class. They highlight the major moral-political dilemma emerging acrossthe EU out of the discord between declared ideals of citizenship and actual exclusion from civil, political, and social rights. Pursuing this overall European predicament, the authors provide a critical scrutiny of the EU's growing policy involvement in the fields of international migration, integration, discrimination, and racism. They relate current policy issues to overall processes of economic integration and efforts to develop a European 'social dimension'. Drawing on case-study analysisof migration, the changing welfare state, and labour markets in the UK, Germany, Italy, and Sweden, the book charts the immense variety of Europe's social and political landscape. Trends of divergence and convergence between single countries are related to the European Union's emerging policies fordiversity and social inclusion. The assumption that EU immigrants pose a net 'welfare burden' on the host member state has sounded loud and wide in recent years. This calls for an empirical test. In this article, we examine the fiscal impact of EU immigration on the universalistic, tax-financed welfare state of Denmark. We analyse EU citizens' contribution to and consumption of welfare benefits between 2002 and 2013 on the basis of a unique dataset of administrative data, consisting of repeated cross sections of 100% of the EU population residing in Denmark. Book excerpt: This article analyzes the political impact of the European Court of Justice's (ECJ) case law concerning the free movement of EU citizens and their cross-border access to social benefits. Public debates about 'welfare migration' or 'social tourism' often fluctuate between populist hysteria and outright denial, but they obscure the real political and legal issues at stake: that ECJ jurisprudence incrementally broadens EU citizens' opportunities to claim social benefits abroad while narrowing member states' scope to regulate and restrict access to national welfare systems. We argue that legal uncertainty challenges national administrations in terms of workload and rule-of-law standards, while domestic legislative reforms increasingly shift the burden of legal uncertainty to EU migrants by raising evidentiary requirements and threatening economically inactive EU citizens with expulsion. We illustrate this argument first with a brief overview of the EU's legal framework, highlighting the ambiguity of core concepts from the Court's case law, and then with empirical evidence from the UK, Germany and Austria, analyzing similar domestic responses to the ECJ's jurisprudence. We conclude that EU citizenship law, while promising to build the union from below on the basis of equal legal entitlements, may, in fact, risk rousing further nationalism and decrease solidarity across the union.
