Book excerpt: Collected Studies CS1071 The central figure in this volume is that of Gratian, whose monumental compilation of canon law sparked off the revival of legal studies in the medieval West. In other collections of essays, Stephan Kuttner dealt with the development of canon law in the two centuries that followed the publication of Gratian's Decretum, and the ideas that this engendered; here he is concerned with the foundations upon which all these later efforts were based. The work of Gratian is, of course, the principal focus, but the studies then follow the spread of the teaching of law, from its inception at Bologna in the 1140s to its appearance soon after in other centres of learning in the West especially in France, in the Anglo-Norman schools and in Germany. With a quarter of the volume consisting of additional notes and extensive indexes, it makes a contribution of the greatest importance to the historical study of canon law. For this second edition, a new section of additional notes has been supplied, and the volume is introduced with an essay by Peter Landau; these take account of the important recent work on Gratian and the Decretum and chart the significance of Stephan Kuttner's work.

Folder 1 contains the Decretum D.49.1 to D50.14. Folder 2 is another copy of the Decretum with gloss and annotations, D.47.8-D.50.22. Folder 3 is also a manuscript of the Decretum, De pen. Folders 4-7 are from one manuscript, a copy of the Decretales. Folder 8 is another copy of the Decretales, 4.21.5. Folder 9 contains a mansucript fragment from Innocent III's Collectio decretalium. Folders 10-12 contain leaves from one manuscript, the Decretales. Folder 13 is another copy of the Decretales, 1.1.21-2.210. Folder 14 contains a papal decretal: "Innocent III Dulmensi episcopo et decano" which is Decretale 2.20.34. Folders 15 contains the Decretales: 2.24.21-23. Folders 16-19 contain leaves from one manuscript, also the Decretales, mostly from book III. Folders 20, 21, 22 contain leaves from different manuscripts of the Decretales: 4.18.6-4.19.3, 5.27.6-5.30.3, and 5.37.12-5.38.11 respectively. Folders 23 and 24 contain leaves from different manuscripts of the Clementinae Constitutiones, 1.1.1-1.2.2 and 5.11.1-5.11.2 respectively. Folder 25 is another manuscript of the Decretales, 3.10.1-3.10.6, 3.13.6-3.16.2, 3.8.15-3.9.2. Folder 26 is a manuscript of the Decretum C. 7 q. 1 c. 49 - C.8 q.9, c.1, and C.10, q. 1, c.1 - C. 10 q. 2 c. 1. Folder 27 contains a manuscript of the Decretales with glossing, 1.38.10 - 1.40.1. Folders 43 and 44 contain leaves from a manuscript of a commentary on the Liber Sextus, 5.11.14-24. Folder 45 is likely a manuscript commentary on the Clementinae Constitutiones. Folder 46 is an alphabetical index from "meritum" to "munifitus". Folders 47-52 are leaves from a manuscript index, or margarita, arranged alphabetically in three columns with added entries and marginal annotations.

Gratian's collection of Church law, the Decretum, was a key text in these developments. Compiled in around 1140, it remained a fundamental work throughout and beyond the Middle Ages. Until now, the many mysteries surrounding the creation of the Decretum have remained unsolved, thereby hampering exploration of the jurisprudential renaissance of the twelfth century. Professor Winroth has now discovered the original version of the Decretum, which has long lain unnoticed among medieval manuscripts, in a version about half as long as the final text. It is also different from the final version in many respects - for example, with regard to the use of of Roman law sources - enabling a reconsideration of the resurgence of law in the twelfth century.
