Book Of the People by the People for the People 2 volumes

Download or read book Of the People by the People for the People 2 volumes written by Thomas J. Baldino and published by Bloomsbury Publishing USA. This book was released on 2010-02-09 with total page 750 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, primary source documents, including Constitutional provisions, federal and state laws, and U.S. court decisions, explain our voting rights and show how the law governs disputed elections and electoral reforms. The hotly disputed election of 2000 roused a generally complacent electorate to recognize the erosion of a basic rite of citizenship many had long taken for granted: the exercise of their right to vote. Since then, controversial technology for casting and counting ballots, as well as numerous initiatives intended to increase voter participation (or, in the case of voter identification laws, arguably to restrict it), have ensured that possible flaws in our electoral system are never far from public consciousness. We perceive these troubling developments as new, yet from the colonial period onward, our history has been marked by fierce political battles over who is entitled to vote and how. With over 100 documents, this book presents and analyzes the documentary record of this ongoing struggle. Organized chronologically, this volume traces the legislative evolution of the franchise in America, as well as the significant federal and state court decisions that interpret the law to either extend or contract access to the vote. In each chapter a distinctive section offers examples of disputed elections (presidential and congressional) and the reform proposals that resulted, such as proposed constitutional amendments to eliminate the Electoral College.

Download or read book Unfree Speech written by Bradley A. Smith and published by Princeton University Press. This book was released on 2003-03-17 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: At a time when campaign finance reform is widely viewed as synonymous with cleaning up Washington and promoting political equality, Bradley Smith, a nationally recognized expert on campaign finance reform, argues that all restriction on campaign giving should be eliminated. In Unfree Speech, he presents a bold, convincing argument for the repeal of laws that regulate political spending and contributions, contending that they violate the right to free speech and ultimately diminish citizens' power. Smith demonstrates that these laws, which often force ordinary people making modest contributions of cash or labor to register with the Federal Election Commission or various state agencies, fail to accomplish their stated objectives. In fact, they have worked to entrench incumbents in office, deaden campaign discourse, burden grassroots political activity with needless regulation, and distance Americans from an increasingly professional, detached political class. Rather than attempting to plug "loopholes" in campaign finance law or instituting taxpayer-financed campaigns, Smith proposes a return to core First Amendment values of free speech and an unfettered right to engage in political activity. Smith finds that campaign contributions have little corrupting effect on the legislature and shows that an unrestrained system of contributions and spending actually enhances equality. More money, not less, is needed in the political system, Smith concludes. Unfree Speech draws upon constitutional law and historical research to explain why campaign finance regulation is doomed and to illustrate the potentially drastic costs of efforts to make it succeed. Whatever one thinks about the impact of money on electoral politics, no one should take a final stand without reading Smith's controversial and important arguments.

Book The Supreme Court

Download or read book The Supreme Court written by Tom S. Clark and published by Cambridge University Press. This book was released on 2019-03-14 with total page 455 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a quantitative history of constitutional law in the United States and brings together humanistic and social-scientific approaches to studying law. Using theoretical models of adjudication, Tom S. Clark presents a statistical model of law and uses the model to document the historical development of constitutional law. Using sophisticated statistical methods and historical analysis of court decisions, the author documents how social and political forces shape the path of law. Spanning the history of constitutional law since Reconstruction, this book illustrates the way in which the law evolves with American life and argues that a social-scientific approach to the history of law illuminates connections across disparate areas of the law, connected by the social context in which the Constitution has been interpreted.
