We know that he never stopped using rhetoric as a bishop. What we do not always know is what we mean by Augustine's rhetoric. Is it the style, the figures of speech, encrypted in strange names like hendiadys or homoioteleuton? We also know that Augustine wrote letters throughout his ecclesiastical career, some of them highly polemical. The scholars tend to see the ancient correspondence as a part of a celebrated ritual of friendship. But has Augustine really used the letters written in the heat of the Donatist controversy within this cultural context? For decades the works of Augustine have been of interest mostly for Church historians and theologians, and rightly so. It is worth noticing, however, that the people who read or listened to them at the time of their composition were alumni of rhetorical and law schools, where they had to read Cicero's speeches and learn from rhetorical handbooks (some authored by himself, other written under his influence). The aim of this study is to prove that Augustine's polemical correspondence is teeming with examples of rhetorical tricks commonly used in courtroom argumentation. I argue that the backbone of Augustine's anti-Donatist letters, that is his patterns of argumentation and strategies of persuasion, is largely formed by the techniques of forensic rhetoric. My aim here is to offer an insight into how Augustine used rhetorical tools inherited from classical theory in building and developing polemical strategies in his anti-Donatist letters. This study should expand our knowledge on such various topics as history of rhetoric, ancient epistolography, polemical literature and Augustine's art as a polemicist.

Their speeches effectively constituted performances that used the speakers’ appearances, gestures, tones of voice, and emotional appeals as much as their words to persuade the jury. Today, all that remains of Attic forensic speeches from the fifth and fourth centuries BCE are written texts, but, as Peter A. O’Connell convincingly demonstrates in this innovative book, a careful study of the speeches’ rhetoric of seeing can bring their performative aspect to life. Offering new interpretations of a wide range of Athenian forensic speeches, including detailed discussions of Demosthenes’ On the False Embassy, Aeschines’ Against Ktesiphon, and Lysias’ Against Andocides, O’Connell shows how litigants turned the jurors’ scrutiny to their advantage by manipulating their sense of sight. He analyzes how the litigants’ words work together with their movements and physical appearance, how they exploit the Athenian preference for visual evidence through the language of seeing and showing, and how they plant images in their jurors’ minds. These findings, which draw on ancient rhetorical theories about performance, seeing, and knowledge as well as modern legal discourse analysis, deepen our understanding of Athenian notions of visuality. They also uncover parallels among forensic, medical, sophistic, and historiographic discourses that reflect a shared concern with how listeners come to know what they have not seen.

Book excerpt: Expressly intended to demonstrate America's national progress toward utopia, the 1893 World's Columbian Exposition in Chicago pointedly excluded the contributions of African Americans. For them, being left outside the gates of the "White City" merely underscored a more general exclusion from America's bright future. Exhibits at the fair were controlled by all-white committees, and those that acknowledged African Americans at all, such as the famous Aunt Jemima pancake exhibit, ridiculed and denigrated them. Many African Americans saw the racist policies of the World's Columbian Exposition as mirroring, framing, and reinforcing the larger horrors confronting blacks throughout the United States, where white supremacy meant segregation, second-class citizenship, and sometimes mob violence and lynching. In response to the politics of exclusion that governed the fair, and of its larger implications, several prominent African Americans resolved to publish a pamphlet that would catalog the achievements of African Americans since the abolition of slavery while articulating the persistent political economy of apartheid in the American South. The authors of this remarkable document included the antilynching crusader Ida B. Wells, the former slave and abolitionist Frederick Douglass, the educator Irvine Garland Penn, and the lawyer and newspaper publisher Ferdinand L. Barnett. Focusing on the narrative poem Lucrece, on four of his late Elizabethan plays (Romeo and Juliet, The Merchant of Venice, Julius Caesar and Hamlet) and on three early Jacobean dramas, (Othello, Measure for Measure and All's Well That Ends Well), Quentin Skinner argues that major speeches, and sometimes sequences of scenes, are crafted according to a set of rhetorical precepts about how to develop a persuasive judicial case, either in accusation or defence. Some of these works have traditionally been grouped together as 'problem plays', but here Skinner offers a different explanation for their frequent similarities of tone. There have been many studies of Shakespeare's rhetoric, but they have generally concentrated on his wordplay and use of figures and tropes. By contrast, this study concentrates on Shakespeare's use of judicial rhetoric as a method of argument. By approaching the plays from this perspective, Skinner is able to account for some distinctive features of Shakespeare's vocabulary, and also help to explain why certain scenes follow a recurrent pattern and arrangement. More broadly, he is able to illustrate the extent of Shakespeare's engagement with an entire tradition of classical and Renaissance humanist thought.

The socially transgressive nature of the crime in Athens resulted in homicide receiving a distinctive treatment in Athenian law, where it was ‘set apart’ from other crimes in a number of ways, including the courts in which it was tried, the procedures involved, and the fact that uniquely these laws were attributed to Drakon as mytho-historical lawgiver. Plastow explores how four distinctive features of homicide procedure and law at Athens played out in rhetoric: ideology, pollution, relevance, and the connected issues of motive and intent. Through exploration of these rhetorical themes, the volume also provides insight into the popular perceptions of homicide amongst the Athenians, since the orators’ speeches make extensive use of persuasive techniques that tap into the deeply held beliefs and ideologies of the jury members. A secondary aim is to explore the effects of the physical context of delivery on the rhetoric of homicide: the courtroom spaces themselves, whether homicide courts or popular courts, with the variable ideologies that their locations and physical attributes provoked, as well as the aspects of ritual that would have been performed physically during a homicide trial.
