Book excerpt: Until recently, the international community failed to adopt either an agreed limit for the breadth of the territorial sea or a satisfactory regime of fisheries in the waters adjacent to the territorial sea. This provoked an eruption of unilateral acts by which coastal states extended their jurisdiction towards the high seas. The Third U.N. Conference on the Law of the Sea accepted the establishment of a 12-mile territorial sea and a 200-mile exclusive economic zone. While taking into account the non-existent rights and interests of the so-called geographically disadvantaged states and of states with broad continental shelves, the 1982 Convention on the Law of the Sea practically ignored existing rights and interests of habitual fishing states. It maintained the well-established principle of freedom of fishing on the high seas but with specific conditions. Dissatisfied with the Convention's regulation of fishing on the high seas, a few states elected to hold a U.N. Conference on Straddling and Highly Migratory Fish Stocks which adopted the 1995 Agreement for the implementation of the provisions of the Convention relating to the conservation and management of such stocks. Similarly, some of these states, like Chile, Argentina, and Canada, adopted legislation extending their jurisdiction beyond their respective 200-mile fishing or exclusive economic zones. This book explores these events in the historical development of the international regulations of fisheries and concludes with a look into recent developments in the area.

Through criminological analysis, The Last Fish Swimming emphasizes the importance of looking at specific environmental factors that make illegal fishing possible. It examines such factors as proximity to known ports where illegally caught fish can be landed without inspection (i.e., ports of convenience), fisheries monitoring, control and surveillance efforts, formal surveillance, and resource attractiveness in 53 countries that altogether represent 96 percent of the world's fish catch. The book calls upon the global community to address the illegal depletion of the world's fish stock and other similar threats to the world's food supply and natural environment in order to ensure the sustainability of the planet's fish and continuation of the legal fishing industry for generations to come.

Book excerpt: Illegal, unreported and unregulated (IUU) fishing constitutes a persistent and pressing problem estimated to account for up to US$23 billion annually in the APFIC area. The effects of IUU fishing can be severe, particularly for small-island and coastal developing states heavily dependent on fisheries, and include adverse impacts on peoples’ livelihoods, food security, national economies and the environment. Countries unable to fulfil international obligations for fisheries management and governance risk incurring trade sanctions on their fisheries exports, an increasing issue as export markets tighten their permitting. Furthermore, IUU fishing is increasingly associated with national and transnational organised criminal activities, although the evidence remains mixed. FAO commissioned this report two years ago to produce an independent update to an unpublished 2015 study on IUU fishing in the APFIC area of competence, which was presented to the APFIC as an information paper in 2016 (FAO 2016a). The 2015 study used a mixture of media reports, literature review, and interviews to build a picture of hotspots of illegal fishing across the APFIC area of competence. This report builds on the previous work, incorporating additional analysis methods to predict illegal fishing in a transparent manner. Based on discussions with the APFIC Secretariat, it was decided to limit the study to the illegal component of IUU fishing. A key difference with the 2015 study is the extension of the estimation of illegal fishing from the 33 hotspots covered in the 2015 study to the entire APFIC area of competence in this study.This report provides the following key outputs: (i) development and implementation of an agreed methodology for estimating illegal fishing levels and progress; (ii) information from case studies in three Asia-Pacific countries; and (iii) analysis of results from the agreed method estimating the incidence of illegal fishing and implication of efforts to reduce it. The approach taken to achieve these goals included a structured online survey of fisheries officials in APFIC countries, semi-structured interviews of key informants knowledgeable about illegal fishing in the APFIC region, and analysis of articles on illegal fishing from public media data across the APFIC area of competence.

Book excerpt: This multi-sited island ethnography illustrates how the embattled politics of (im)mobility, belonging, and patronage among coastal fishing communities in Sri Lanka ́s militarised northeast have intersected in the wake of civil war. It explores an undertheorized puzzle by asking how the conceptual dualisms between co-operation and contestation simplify the complex lifeworlds of small-scale fishing communities that are often imagined by scholars through allegories of rivalry and resource competition. Drawing on ordinary interpretations and lived practices implicated in the vernacular term sambandam (bearing multiple meanings of intimacy and entanglement), the book traces how intergroup co-operation is both affectively routinised and tactically instrumentalised across coastlines, and at sea. Given its distinct focus on translocal and ethno-religiously plural collectives, the study maps recent historic formations of diverse practices and their contentions, from networked ‘piracy’ and dynamite fishing, to collective rescue missions and coalitional lobbying. Moreover this work serves as an open invitation to academics, policymakers and activists for re-imagining multiple modes of ethical being and doing, and of everyday sociality among so-called ‘deeply divided’ societies. A rich ethnography that pays meticulous attention to a complex social fabric made up of locals, settlers and migrants, with multiple linguistic and religious affiliations, sometimes contending fishing practices, and migration and livelihoods patterns as they have been affected by tsunami, war and the aftermaths of both. In 1976, defeat in the Anglo-Icelandic Cod Wars saw the British trawling fleet excluded from their traditional hunting grounds. Combining with wider global factors, the move brought an end to long-established trawling practices, with profound social, economic and cultural repercussions. Through a case study of the port of Hull, oral history and archival research explore the challenges, responses and legacy of rapid change. Although the emphasis is on Hull, this is far from a local history. Hull’s position among the world leading distant-water pioneers gives the story international significance. Focusing on memory, lived experience and place, the book goes beyond established narratives. Personal acts of remembering offer cultural perspectives on how global events and marine policy impact upon the seafaring communities that live with the consequences. The Cod Wars signaled an end, yet amid the disruption there were also new beginnings.
