FirstNet was created by Congress with provisions in Title VI (Spectrum Act) of the Middle Class Tax Relief and Job Creation Act of 2012 to ensure the deployment and operation of a nationwide, broadband network for public safety communications. It is established as an "independent authority" within the National Telecommunications and Information Administration (NTIA), part of the Department of Commerce. There are many challenges for public safety leaders and policymakers in establishing the framework for a nationwide network that meets state, local, tribal and territorial needs for robust, interoperable emergency communications. Currently, for example, state emergency communications needs are typically met by separate networks using different technologies. Furthermore, each state has its own laws and procedures for building, managing, and funding communications infrastructure. Among the challenges facing FirstNet is establishing a governance model that accommodates current investments and future needs of its clients without compromising the coherence of a national network. This book discusses the elements, issues, and progress made by FirstNet.

Book excerpt: Since September 11, 2001, when communications failures contributed to the tragedies of the day, Congress has passed several laws intended to create a nationwide emergency communications capability. Yet the United States has continued to strive for a solution that assures seamless communications among first responders and emergency personnel at the scene of a major disaster. To address this problem, Congress included provisions in the Middle Class Tax Relief and Job Creation Act of 2012 (P.L. 112-96) for planning, building, and managing a new, nationwide, broadband network for public safety communications (FirstNet), and assigned additional radio frequency spectrum to accommodate the new network. In addition, the act has designated federal appropriations of over $7 billion for the network and other public safety needs. These funds will be provided through new revenue from the auction of spectrum licenses. These and other public safety and spectrum provisions of the act appear in Title VI, known as the Public Safety and Spectrum Act, or Spectrum Act.

It is intended to address communication failures that slowed recovery efforts during major national emergencies, including the 9/11 attacks and Hurricane Katrina. States like Mississippi know firsthand the consequences of communications network breakdown. FEMA, Red Cross, and others were hindered from providing the emergency recovery services needed during and after Katrina. The 2012 Act allocated $7 billion from spectrum auction proceeds for the purpose of building and operating a nationwide public safety broadband network. The spectrum auction raised the $7 billion needed to begin the planning and development stage. Although FirstNet has made progress, questions linger about the future viability of the network. FirstNet is committed to providing rural communities with the same services as larger urban cities, but rural and remote coverage remains a major concern. Each region of the country faces a unique set of challenges, and addressing these challenges is critical to achieving nationwide deployment of FirstNet.

Book excerpt: GAO's ongoing work has found that the First Responder Network Authority (FirstNet) has made progress carrying out the responsibilities established in the 2012 Middle Class Tax Relief and Job Creation Act (the 2012 act) but lacks certain elements of effective internal controls. FirstNet has made progress establishing an organizational structure, planning the nationwide public-safety broadband network, and consulting with stakeholders. Nevertheless, stakeholders GAO contacted cited upcoming issues, such as deciding the level of network coverage, which will be difficult for FirstNet to address as it continues to carry out its responsibilities. With respect to internal controls, FirstNet has begun establishing policies and practices consistent with federal standards, but it has not fully assessed its risks or established Standards of Conduct. Given that FirstNet faces a multitude of risks to achieve its complex objectives, fully assessing risks would help FirstNet respond to risks in a proactive way. Developing standards of conduct would help FirstNet address conduct and performance issues in a timely manner. A nationwide public-safety broadband network is estimated to cost billions of dollars, and FirstNet faces difficult decisions determining how to fund the network's construction and ongoing operations. Various entities have estimated the cost to construct and operate such a network from $12 to $47 billion over the first 10 years. The actual cost of FirstNet's network will be influenced by FirstNet's (1) business model, especially the extent of commercial partnerships; (2) use of existing infrastructure; (3) efforts to ensure network reliability; and (4) network coverage. For example, the cost of the network will likely increase if FirstNet does not utilize commercial partnerships and at least some existing infrastructure. The 2012 act provides FirstNet $7 billion to establish the network. To become self-funding, FirstNet is authorized to generate revenue through user fees and commercial partnerships, the latter of which can involve secondary use of the network for non-public safety services. However, GAO's ongoing work suggests that FirstNet faces difficult decisions in determining how to best utilize these revenue sources. For instance, widespread network coverage can attract more users, and thus user fee revenue, but is expensive to construct and maintain, especially in rural areas.
