This book was released on 2011-06-17 with total page 68 pages. Available in PDF, EPUB and Kindle. Book excerpt: The House of Lords Economic Affairs Committee reports on aspects of the Government's taxation plans before the House of Commons again discusses this year's Finance Bill at Report Stage. The Committee, which brings together economic and financial experience from business and politics, points to four main areas for Government attention: tax policy; scrutiny; tax avoidance and evasion; and corporation tax reforms. The Government must stick to its own commitment to a new, consultative approach to tax policymaking if it is to achieve its aim of giving the UK the clear, stable and predictable tax system which it needs to be competitive. The Government's new approach is welcomed but has so far not been implemented consistently. The Government's failure to consult on the increased charges on oil and gas production it announced in the Budget was criticised for putting investment in the oil and gas industry at risk. Many witnesses called for earlier Parliamentary scrutiny of the Finance Bill measures. The Government must act earlier to curb tax avoidance and evasion. The Committee criticises proposed legislation against "disguised remuneration" for tackling the problem too late and for being excessively long and complex. The Government should consult earlier so that it can put forward better Finance Bill legislation. The Committee also calls for the Government to develop a strategy to tackle tax evasion. The Government should monitor its corporation tax reforms to make sure that they do not accidentally disadvantage particular groups, for example small and medium-sized businesses.

This book was released on 2013-03-13 with total page 86 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Draft Finance Bill 2013 (HL 139) evaluates the draft Finance Bill which, following detailed consultations based on the findings of an independent study group, includes proposals for a General Anti-Abuse Rule (GAAR), narrowly targeted at abusive transactions which fail a stringent 'double reasonableness' test. The provisions also include the formation of an Advisory Panel to agree guidance and give its opinion on the application of the double reasonableness test to a given set of tax arrangements. Most agree the narrow focus was appropriate. Some witnesses argued that HM Revenue and Customs (HMRC) should set up a clearance system to reduce uncertainty about where the GAAR would apply. Many witnesses were very concerned at the application of the GAAR to transactions involving inheritance tax planning. The Bill also includes an Annual Residential Property Tax Package (ARPT) which is part of a package of measures to address Stamp Duty Land Tax avoidance by

Book Corporate Liability for Insider Trading

Download or read book Corporate Liability for Insider Trading written by Juliette Overland and published by Routledge. This book was released on 2019-03-05 with total page 207 pages. Available in PDF, EPUB and Kindle. Book excerpt: Corporate Liability for Insider Trading examines the reasons why there have been no successful criminal prosecutions, or successful contested civil proceedings, against corporations for insider trading, and analyses the various rationales for prohibiting insider trading. It reviews the insider trading regulatory regime and describes its key features, using both national and international examples. The book inspects a variety of criminal and civil models of corporate liability and considers the historical and theoretical basis on which corporations are subject to insider trading laws. The specific elements of the insider trading offence and the manner in which they are attributed to corporations are analysed in detail. Defences available to corporations such as Chinese Walls are explored, and the obligations that are imposed on businesses as a result of insider trading regulation – security trading policies and notifications, continuous disclosure obligations, and duties concerning conflicts of interest – are detailed and examined. The book concludes with reform proposals intended to remedy the many legal and commercial difficulties identified, in order that a new regulatory regime might be adopted to better serve regulators, businesses, investors, and the broader market. This volume addresses these corporate law topics and will be of interest to researchers, academics, financial institution compliance officers, investment bankers, corporate and comparative lawyers, and students and scholars in the fields of commercial law, corporate law, financial crime, company law, and white collar crime

  • ISBN : 9780105619116

Download or read book Pensions Act 2011 written by Great Britain and published by The Stationery Office. This book was released on 2011-11-08 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Pensions Act 2011 amends the timetable for increasing the state pension age to 66. Under the Pensions Act (PA) 2007, the increase to 66 was due to take effect between 2024 and 2026. This Act will bring forward the increase so that state pension age for both men and women will begin rising from 65 in December 2018 to reach 66 by October 2020. As a result of bringing forward the increase to 66, the timetable contained in the PA 1995 for equalising women's state pension age with men's at 65 by April 2020 will be accelerated, so that women's state pension age reaches 65 by November 2018. The Act introduces amendments to primary legislation to amend the regulatory framework for the duty on employers to automatically enrol eligible workers into a qualifying pension scheme and to contribute to the scheme. These measures implement recommendations from the Making Automatic Enrolment Work review (Cm. 7954, ISBN 9780101795425). The Act amends existing legislation that provides for revaluation or indexation of occupational pensions and payments by the Pension Protection Fund. This Act also contains a number of measures to correct particular references in the existing body of pensions-related legislation and other small and technical measures to both state and private pension legislation. The Act is in six parts. The amendments made by the Act generally extend to England and Wales and to Scotland.

Book The EU Economic and Social Model in the Global Crisis

Download or read book The EU Economic and Social Model in the Global Crisis written by Dagmar Schiek and published by Routledge. This book was released on 2016-02-11 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the viability of the EU economic and social model within and after the global economic crisis. It identifies four key issues which warrant further discussion: (1) the asymmetry of the legal and policy framework of the euro and potential recalibration; (2) substantive tensions between the EU ’economic constitution’ and its normative aim of social justice and impacts on national policy; (3) the role of civil society, including the two sides of industry in overcoming these tensions; and (4) the EU’s global aspirations towards the creation of a viable socio-economic model. Its chapters offer two perspectives on each of the four main issues. In drawing these debates together, the book provides a broad understanding as well as starting points for future research. Bringing together different disciplinary approaches, ranging from legal studies to political economy, sociology and macroeconomics, it is a valuable contribution to the debate on the European social model and introduces new insights by focusing on legal and political tensions, the impact of the financial crisis and other economic contexts as well as global dimensions.

Book International Economic Law after the Global Crisis

Download or read book International Economic Law after the Global Crisis written by C. L. Lim and published by Cambridge University Press. This book was released on 2015-04-30 with total page 575 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection explores the theme of fragmentation within international economic law as the world emerges from the 2008 global financial crisis, the subsequent recession and the European sovereign debt crisis which began in early 2010. The post-crisis 'moment' itself forms a contemporary backdrop to the book's focus on fragmentation as it traces the evolution of the international economic system from the original Bretton Woods design in the aftermath of the Second World War to the present time. The volume covers issues concerning monetary cooperation, trade and finance, trade and its linkages, international investment law, intellectual property protection and climate change. By connecting a broad, cross-disciplinary survey of international economic law with contemporary debate over international norm and authority fragmentation, the book demonstrates that this has been essentially a fragmented and multi-focal system of international economic regulation.
