To sustain growth and foreign investment over the long run requires a well-developed legal infrastructure for conducting business, including cheap and reliable contract enforcement and secure property rights. But it’s widely acknowledged that India’s legal infrastructure is in urgent need of reform, plagued by problems, including slow enforcement of contracts and land laws that differ from state to state. How has this situation arisen, and what can boost business confidence and encourage long-run economic growth? Tirthankar Roy and Anand V. Swamy trace the beginnings of the current Indian legal system to the years of British colonial rule. They show how India inherited an elaborate legal system from the British colonial administration, which incorporated elements from both British Common Law and indigenous institutions. In the case of property law, especially as it applied to agricultural land, indigenous laws and local political expediency were more influential in law-making than concepts borrowed from European legal theory. Conversely, with commercial law, there was considerable borrowing from Europe. In all cases, the British struggled with limited capacity to enforce their laws and an insufficient knowledge of the enormous diversity and differentiation within Indian society. A disorderly body of laws, not conducive to production and trade, evolved over time. Roy and Swamy’s careful analysis not only sheds new light on the development of legal institutions in India, but also offers insights for India and other emerging countries through a look at what fosters the types of institutions that are key to economic growth.

Book excerpt: Frank David Ascoli’s Revenue History of Sundarbans during the Period 1870- 1920 looks at the area bounded on the north by the limits of Permanent Settlement in 24-Parganas, Khulna and Bakarganj districts and on the south by the sea face stretching from the Hughli estuary to the mouth of the Meghna River. A quarter of this large area consisted of water out of 19,501 sq. km. For administrative purposes the Division was grouped in three circles known as the Bagerhat, Khulna and Satkhira. Revenue stations were established at all the principal points of egress from the Sundarbans, and purchasers proceed to the forests and take their requirements from any locality they choose. The process of land formation appears to have been followed by the growth of different vegetation and plants which turned into forest it left uncleared. The entire Sundarban tract is managed by the Forest Department, which has operated a yearly auction for cutting rights for many decades. In this way the Sundarbans emerged between the Bay of Bengal and the fringes of the Bengal delta. The revenue history of the Sundarbans is distinct from that of the rest of the district that presents several peculiar features, so that a separate account of it is necessary. It is apparent that some of the most forbidding remnants of Sundarbans jungle were transformed into fertile rice fields, schools, dispensaries, post offices, markets and cooperative societies. Book excerpt: This study is an attempt to show how religious, kinship and factional ties cut across class alignments, leading to the communalization of class struggle between the peasants and the exploiting classes in East Bengal during 1920-1947. "During a substantial stay in some East Bengal villages in the summer of 1971, when East Pakistan was in the traumatic process of being transformed into Bangladesh, it first dawned upon me that peasants were not stupid, devoid of political consciousness. Discussions with different types of peasants revealed that at least the upper echelons were aware of the implications of the liberation struggle for Bangladesh and the superpower involvement in it. Richard Nixon and Indira Gandhi were familiar names. Ordinary peasants often quoted the Bengali news readers and commentators of the BBC world service and the Voice of America. Well-to-do peasants who owned transistor radio sets regularly tuned into the British, American and Indian radio stations. Many inquisitive and worried peasants asked me (then a fresh graduate from Dhaka University) how their cherished Sonar Bangla (golden Bengal) would improve their socio-economic conditions. Many peasants also took part in the liberation struggle as members of the Mukti Bahini or freedom fighters. Almost everyone, with a few exceptions who collaborated with the Pakistan armed forces, was a keen supporter of Bangladesh. After the emergence of Bangladesh, things did not change to the expectations of the masses, but rather deteriorated so much that Henry Kissinger is said to have coined the phrase ''bottomless basket"" as a denotation for Bangladesh, because of the rampant corruption of a big section of the Bengali bourgeoisie at that time. I was provoked to write the history of the peasants' glorious role in the Liberation Struggle which was being overshadowed by claims and counter-claims of heroism and sacrifice by members of the privileged, parasitical urban elites. This work may be regarded as a prelude to the history of the freedom struggle that eventually led to the creation of Bangladesh. This is an attempt to shed light on the peasant politics, almost synonymous with Muslim politics in the region, during the significant period between 1920 and 194 7 when East Bengal was going through the political process that culminated in the creation of East Pakistan in 194 7."
