Available in PDF, EPUB and Kindle. Book excerpt: This anthology brings together a selection of writings by ombudsman experts that explore various aspects of the contemporary public sector ombudsman. Originally published in International Ombudsman Institute publications, these articles illustrate the diversity of ombudsman offices around the world and underscore the elements and issues that are important to all ombudsman institutions. From its Scandinavian roots, the ombudsman model has been established worldwide and at all levels of government as a mechanism to monitor and improve government administration. The model has seen renewed interest in the past decade in democratizing countries which are reforming their governmental institutions, such as in Latin America, Central and East Europe, Africa and the Asia Pacific region. This anthology explores the essential elements of the public sector ombudsman and the emerging mandates of the ombudsman institution both in established and consolidating democracies. In particular, the role of the ombudsman in human rights protection is scrutinized from a variety of perspectives. The anthology also includes critical analyses of the extent of the jurisdiction of the public sector ombudsman, focusing on matters such as the relationship of the ombudsman with administrative tribunals and the courts. Issues surrounding the ombudsman process of investigation, recommendation and reporting are highlighted - such as administrative fairness in the ombudsman process, special investigations, public education about the office and media relations.

Download or read book The Ombudsman in the Modern State written by Matthew Groves and published by Bloomsbury Publishing. This book was released on 2022-04-07 with total page 411 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ombudsmen are a global phenomenon. They are also a critical part of the public law frameworks of modern liberal democracies. This is the first edited collection to examine the place of the ombudsman in the modern state. It brings together key international scholars to discuss current and future challenges for the Ombudsman institution and the systems of government within which they operate. The book is international in scope with authors heralding from most continents - Canada, the Netherlands, the United Kingdom, Australia, New Zealand, Hong Kong, South Africa, Germany, and Austria. This global analysis is both in-depth and expansive in its coverage of the operation of Ombudsmen across civil and common law legal systems. The book has two key themes: - The enduring question of the location and operation of Ombudsmen within public law systems in a changing state, and - The challenges faced by Ombudsmen in contemporary governance. This collection adds to the public law scholarship by addressing a common problem faced by all avenues of public law review – the evolving nature of modern public administration.
Download or read book A Question of Commitment written by Thomas Waldock and published by Wilfrid Laurier Univ. Press. This book was released on 2020-04-09 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the adoption of the United Nations Convention on the Rights of the Child (1989), commentators began to situate the evolution of the status of children within the context of the “property to persons” trajectory that other human rights stories had followed. In the first edition of A Question of Commitment, editors R. Brian Howe and Katherine Covell provided a template of analysis for understanding this evolution. They identified three overlapping stages of development as children transitioned from being regarded as objects to subjects in their own right: social laissez-faire, paternalistic protection, and children’s rights. In the social laissez-faire stage, children are regarded as objects, and largely as the property of parents. In the paternalistic protection stage, children are seen as vulnerable and in need of protection. The children’s rights stage lays emphasis on children as rights-bearers, as individuals in their own right with entitlements. In this second edition, new essays assess the extent to which children’s rights have been incorporated into their respective areas of policy and law. The authors draw conclusions about what the situation reveals about the status of children in Canada. Overall, many challenges remain on the pathway to full recognition and citizenship.

Download or read book The Future of Remedies in Europe written by Claire Kilpatrick and published by Bloomsbury Publishing. This book was released on 2000-12-05 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: Remedies lie at the heart of European legal systems. They both reflect and shape the balance of power between states and individuals and between state and supranational institutions. These profound political implications can be better understood by thinking about the functional roles and institutional histories of remedies. These implications, roles and histories are considered in this volume of challenging and original essays on remedial systems in Europe. This book explores the lively and often controversial dialogues between courts, national and supranational, on remedies. In so doing, it addresses the adequacy of these dialogues in the light of perceived systemic goals, both in an overall institutional sense and as regards specific sectoral objectives or institutional actors' aspirations. In particular, the book looks at the way in which remedies in the EC legal order interact with those in other legal orders such as the Council of Europe and private international law. It also identifies problems of interaction between different Council of Europe mechanisms under the Convention on Human Rights and the Social Charter. The book also examines the contribution of courts to remedial systems by considering other methods of formulating and redressing claims.
