In Fetal Rights, Women's Rights, Suzanne Samuels analyzes these policies and the ambiguous responses to them by federal and state courts, legislatures, administrative agencies, litigants, and interest groups. She poses provocative questions about the implicit links between social welfare concerns and paternalism in the workplace, including: are women workers or wombs? Placing the fetal protection controversy within the larger societal debate about gender roles, Samuels argues that governmental decision-makers confuse sex, which is based solely on biological characteristics, with gender, which is based on societal conceptions. She contends that the debate about fetal protection policies brought this ambiguity into stark relief, and that the response of policy-makers was rooted in assumptions about gender roles. Book excerpt: The assessment and control of fetal exposure to radiation in the workplace is an issue that is complicated by both biological and political/social ramifications. As a result of the dramatic increase in the number of women employed as radiation workers during the past 10 years, many facilities using radioactive materials have instituted fetal protection programs with special requirements for female radiation workers. It is necessary, however, to ensure that any fetal protection program be developed in such a way as to be nondiscriminatory. A study has been initiated whose purpose is to balance the political/social and the biological ramifications associated with occupational protection of the developing embryo/fetus. Several considerations are involved in properly balancing these factors. These considerations include appropriate methods of declaring the pregnancy, training workers, controlling the dose to the embryo/fetus, measuring and calculating the dose to the embryo/fetus, and recording the pertinent information. Alternative strategies for handling these factors while ensuring maximum protection of the embryo/fetus and the rights and responsibilities of employees and employers are discussed.

Government and corporate policies to define and enforce fetal rights have become commonplace. These developments affect all women—pregnant or not—because women are considered "potentially pregnant" for much of their lives. In her powerful and important book, Rachel Roth brings a new perspective to the debate over fetal rights. She clearly delineates the threat to women's equality posed by the new concept of "maternal-fetal conflict," an idea central to the fetal rights movement in which women and fetuses are seen as having interests that are diametrically opposed. Roth begins by placing fetal rights politics in historical and comparative context and by tracing the emergence of the notion of fetal rights. Against a backdrop of gripping stories about actual women, she reviews the difficulties fetal rights claims create for women in the areas of employment, health care, and drug and alcohol regulation. She looks at court cases and state legislation over a period of two decades beginning in 1973, the year of the Roe v. Wade decision legalizing abortion. Her exhaustive research shows how judicial decisions and public policies that grant fetuses rights tend to displace women as claimants, as recipients of needed services, and ultimately as citizens. When a corporation, medical authority, or the state asserts or accepts rights claims on behalf of a fetus, the usual justification involves improving the chance of a healthy birth. This strategy, Roth persuasively argues, is not necessary to achieve the goal of a healthy birth, is often counterproductive to it, and always undermines women's equal standing.

Book excerpt: This article examines recent "fetal protection" efforts, which demonize, disenfranchise, and punish pregnant women. These actions erase the bright line of birth which has historically distinguished children from fetuses, and include criminal prosecutions of pregnant women, civil commitments of pregnant women who use alcohol and other drugs, and fetal "guardianship" proceedings. The article critiques the ostensible rationale of fetal protection - that by treating the "unborn" as children, the government will support the birth and life of healthier children - and suggests that the real goal of fetal protection is to limit abortion rights and the ability of women to participate equally in the workplace. But even if the goal of fetal protection was actually to ensure the birth of healthy children, the means chosen are insufficient, discriminatory, and counter-productive. Fetal protection initiatives are insufficient because they focus only on one narrow aspect of risk to fetal and child health, ignoring exposures in the environment and workplace which place many fetuses and children at risk. The new fetal protection is discriminatory. Fetal protection proponents overlook the risks created by the use of assisted reproductive technology, used primarily by wealthier women, and largely ignore the risks posed by alcohol and tobacco use, which is much more widespread than the use of illicit drugs. Instead, fetal protection efforts fall disproportionately at poor women and women of color. Fetal protection efforts are counter-productive, discouraging pregnant women who are using alcohol and other drugs from speaking candidly to their physicians. Most importantly, fetal protection initiatives fail to address the systemic problems of domestic violence, poverty, and lack of access to health care which make it difficult for pregnant women with substance abuse problems to overcome their drug addiction. The article shows how government could achieve the goal of bringing healthy children into the world, by implementing a comprehensive public health strategy to promote women's and children's health across the lifespan, not just during the few months when women are pregnant.
