Book The Stateless Market

Download or read book The Stateless Market written by Paul Kapteyn and published by Routledge. This book was released on 2002-09-11 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a broad view of the tension between state and market in the political evolution of the European Union. Contemporary developments and issues are set within the historical context of state formation. Paul Kapteyn argues that states are invariably formed by violent conquest, or by fusion in the face of an external threat; and that markets can emerge only only when the state has been established. He points out that while the histories of France, Britain, The Netherlands and Germany conform to these rules, the European Union does not; and he goes on to explore the reasons why this is not so, and its implications. The second section of the book is based on empirical research. Paul Kapteyn underpins his theoretical and historical argument with an analysis of official documents, newspaper articles and interviews with Eurocrats form the various member states. He concentrates especially on two case studies, of the Treaty of Schengen on judicial cooperation and harmonization, and of the problem of EU fraud. He also looks closely at eh consquences of the Maastricht Treaty. The Stateless Marlet is a thought-provoking text, ideally suited to students on European studies, politics, international relations and sociology courses. it will also be of great interest to those professionally concerned with European integration.

Book The Politics of International Criminal Justice

Download or read book The Politics of International Criminal Justice written by Ronen Steinke and published by Bloomsbury Publishing. This book was released on 2012-05-25 with total page 160 pages. Available in PDF, EPUB and Kindle. Book excerpt: To anyone setting out to explore the entanglement of international criminal justice with the interests of States, Germany is a particularly curious, exemplary case. Although a liberal democracy since 1949, its political position has altered radically in the last 60 years. Starting from a position of harsh scepticism in the years following the Nuremberg Trials, and opening up to the rationales of international criminal justice only slowly - and then mainly in the context of domestic trials against functionaries of the former East German regime after 1990 - Germany is today one of the most active supporters of the International Criminal Court. The climax of this is its campaigning to make the ICC independent of the UN Security Council - a debate in which Germany took a position in stark contrast to the United States. This book offers new insight into the debates leading up to such policy shifts. Drawing on government documents and interviews with policymakers, it enriches a broader debate on the politics of international criminal justice which has to date often been focused primarily on the United States.

This book was released on 1997-03-12 with total page 1168 pages. Available in PDF, EPUB and Kindle. Book excerpt: The studies which are published in this book are the general reports and some of the conference papers which were discussed at the 1st World Law Conference, which was held in Brussels, 9-12 September, 1996. Reports on the discussions during the sessions are also included. This conference was based on the International Encyclopaedia of Laws, which now covers 18 major fields of law and is published by Kluwer Law International. The authors and participants, who were from no less than 50 countries, met in order to build bridges of understanding across cultural boundaries in an attempt to grasp, appreciate and respect both similarities and differences in order to be able to work together with a better understanding of the culture and traditions which form each country's unique legal culture. This is why `culture And The law' was the major theme of the conference. Different fields of law were covered in 30 general reports, highlighting recent developments in their respective fields, and were discussed in 12 work groups (apart from Law and Culture): Civil Procedure, Constitutional Law, Contract Law, Criminal Law, Environmental Law, Family and Succession Law, Intellectual Property Law, Labour Law and Industrial Relations, Medical Law, Social Security and Transport Law. In publishing them the editor and authors want to share the knowledge and insights they contain with the global legal community.

Book Crime and Criminal Justice in Modern Germany

Download or read book Crime and Criminal Justice in Modern Germany written by Richard F. Wetzell and published by Berghahn Books. This book was released on 2014-05-01 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of criminal justice in modern Germany has become a vibrant field of research, as demonstrated in this volume. Following an introductory survey, the twelve chapters examine major topics in the history of crime and criminal justice from Imperial Germany, through the Weimar and Nazi eras, to the early postwar years. These topics include case studies of criminal trials, the development of juvenile justice, and the efforts to reform the penal code, criminal procedure, and the prison system. The collection also reveals that the history of criminal justice has much to contribute to other areas of historical inquiry: it explores the changing relationship of criminal justice to psychiatry and social welfare, analyzes representations of crime and criminal justice in the media and literature, and uses the lens of criminal justice to illuminate German social history, gender history, and the history of sexuality.
