Many experts agree the FBI has made progress in some areas (dissemination of raw intelligence), but some believe that the FBI has shown little progress in other areas (establishing an integrated and proactive intelligence program) while the FBI's budget increased by 68 per cent from 2001-2005. The Weapons of Mass Destruction Commission has recommended, and the White House has approved, the establishment of a National Security Service within the FBI. This Service would integrate the FBI's Counterterrorism and Counterintelligence Division with the FBI's Directorate of Intelligence (DI). Whether this organisational change will yield substantive results is an open question. This book analyses the FBI's overall intelligence reform effort, focusing on the implementation of intelligence reform initiatives in the field.

Until now, those failures have been attributed largely to individual mistakes. But Zegart shows how and why the intelligence system itself left us vulnerable. Zegart argues that after the Cold War ended, the CIA and FBI failed to adapt to the rise of terrorism. She makes the case by conducting painstaking analysis of more than three hundred intelligence reform recommendations and tracing the history of CIA and FBI counterterrorism efforts from 1991 to 2001, drawing extensively from declassified government documents and interviews with more than seventy high-ranking government officials. She finds that political leaders were well aware of the emerging terrorist danger and the urgent need for intelligence reform, but failed to achieve the changes they sought. The same forces that have stymied intelligence reform for decades are to blame: resistance inside U.S. intelligence agencies, the rational interests of politicians and career bureaucrats, and core aspects of our democracy such as the fragmented structure of the federal government. Ultimately failures of adaptation led to failures of performance. Zegart reveals how longstanding organizational weaknesses left unaddressed during the 1990s prevented the CIA and FBI from capitalizing on twenty-three opportunities to disrupt the September 11 plot. Spying Blind is a sobering account of why two of America's most important intelligence agencies failed to adjust to new threats after the Cold War, and why they are unlikely to adapt in the future.

Book excerpt: The Intelligence Community, including the Federal Bureau of Investigation (FBI), has been criticized for failing to warn of the attacks of September 11, 2001. In a sweeping indictment of the FBI's intelligence activities relating to counterterrorism and September 11, the Congressional Joint Inquiry Into the Terrorist Attacks of September 11, 2001, singled out the FBI in a significant manner for failing to focus on the domestic terrorist threat; collect useful intelligence; analyze strategic intelligence; and to share intelligence internally and with other members of the Intelligence Community. The Joint Inquiry concluded that the FBI was seriously deficient in identifying, reporting on, and defending against the foreign terrorist threat to the United States. The FBI is responding by attempting to transform itself into an agency that can prevent terrorist acts, rather than react to them as crimes. The major component of this effort is restructuring and upgrading of its various intelligence support units into a formal and integrated intelligence program, which includes the adoption of new operational practices, and the improvement of its information technology. FBI Director Robert S. Mueller, III, has introduced reforms to curb the autonomy of the organization's 56 field offices by consolidating and centralizing FBI Headquarters control over all counterterrorism and counterintelligence cases. He has also established (1) an Executive Assistant Director for Intelligence (EAD-I); (2) an Office of Intelligence to exercise control over the FBI's historically fragmented intelligence elements; and (3) field intelligence groups to collect, analyze, and disseminate intelligence. Reactions to these FBI reforms are mixed. Critics contend the reforms are too limited and have implementation problems. More fundamentally, they argue that the gulf between law enforcement and intelligence cultures is so wide, that the FBI's reforms, as proposed, are unlikely to succeed. They believe the FBI will remain essentially a reactive law enforcement agency, significantly constrained in its ability to collect and exploit effectively intelligence in preventing terrorist acts. Supporters counter that the FBI can successfully address its deficiencies, particularly its intelligence shortcomings, and that the Director's intelligence reforms are appropriate for what needs to be done. In the most recent iteration of the debate, the 9/11 Commission concluded that the FBI has made significant progress in improving its intelligence capabilities, and generally endorsed Director Mueller's reforms, rejecting the creation of a new domestic intelligence agency. This report identifies five options for Congress to consider, including the creation of a domestic intelligence agency like Great Britain's MI-5. Other options include maintaining the status quo, transferring such responsibilities to the Department of Homeland Security or to the Director of Central Intelligence, or creating a national security intelligence service within the FBI. Meanwhile, for a variety of reasons, the 9/11 Commission has recommended leaving counterterrorism.

From that investigation and his own personal fact-finding, Graham discovered disturbing evidence of terrorist activity and a web of complicity: • At one point, a terrorist support network conducted some of its operations through Saudi Arabia’s U.S. embassy–and a funding chain for terrorism led to the Saudi royal family. • In February 2002, only four months after combat began in Afghanistan, the Bush administration ordered General Tommy Franks to move vital military resources out of Afghanistan for an operation against Iraq–despite Franks’s privately stated belief that there was a job to finish in Afghanistan, and that the war on terrorism should focus next on terrorist targets in Somalia and Yemen. • Throughout 2002, President Bush directed the FBI to limit its investigations of Saudi Arabia, which supported some and possibly all of the September 11 hijackers. • The White House was so uncooperative with the bipartisan inquiry that its behavior bore all the hallmarks of a cover-up. • The FBI had an informant who was extremely close to two of the September 11 hijackers, and actually housed one of them, yet the existence of this informant and the scope of his contacts with the hijackers were covered up. • There were twelve instances when the September 11 plot could have been discovered and potentially foiled. • Days after 9/11, U.S. authorities allowed some Saudis to fly, despite a complete civil aviation ban, after which the government expedited the departure of more than one hundred Saudis from the United States. • Foreign leaders throughout the Middle East warned President Bush of exactly what would happen in a postwar Iraq, and those warnings went either ignored or unheeded. As a result of his Senate work, Graham has become convinced that the attacks of September 11 could have been avoided, and that the Bush administration’s war on terrorism has failed to address the immediate danger posed by al-Qaeda, Hezbollah, and Hamas in Afghanistan, Syria, Yemen, and Somalia. His book is a disturbing reminder that at the highest levels of national security, now more than ever, intelligence matters.

The Weapons of Mass Destruction Commission has recommended, and the White House has approved, the establishment of a National Security Service within the FBI. This Service would integrate the FBI's Counterterrorism and Counterintelligence Divisions with the FBI's Directorate of Intelligence (DI). Whether this organizational change will yield substantive results is an open question. There are at least two schools of thought with respect to how the FBI has performed in implementing its intelligence reform initiatives. The "optimists" believe there is a critical synergy between the law enforcement and intelligence disciplines, and that the FBI has successfully made changes throughout its history to respond to the threats of the time. Since the FBI's vision for intelligence reform is sound, success is simply a matter of implementing that vision. Alternatively, the "skeptics" believe that law enforcement and intelligence are distinct disciplines demanding different skill sets to achieve different ends. They argue the FBI's vision is fundamentally unsound, and its ongoing implementation has not yielded an integrated intelligence program. According to this group, intelligence collection remains effectively separated from intelligence analysis at the FBI. This report analyzes the FBI's overall intelligence reform effort, focusing on the implementation of intelligence reform initiatives in the field. Reform policies designed at FBI Headquarters, with field input, may be of marginal utility unless they are fully and effectively implemented across the 56 FBI field offices. The Congressional Research Service (CRS) examined the FBI's reform initiatives with a focus on the implementation of the field intelligence group concept, at five field offices. Allowing for varying levels of progress across field offices, a central tenet of a high-order functioning intelligence organization is its ability to harness collection resources to nationally developed intelligence priorities and gaps. While areas of promise exist, field research indicates that the FBI's ability to formally harness intelligence collection (including systemic accountability mechanisms) to analytically identified intelligence gaps, remains nascent. In addition, this report discusses several overall options for Congress in addressing FBI intelligence reform. Organizationally and structurally, Congress could establish a stand-alone domestic intelligence agency. Alternatively, it could codify the recently announced National Security Service within the FBI. Potential areas are outlined for functional oversight, including the FBI-CIA relationship, and the FBI's efforts to stanch terrorism finance. And finally, the report reviews options for addressing the FBI's intelligence budget, both at the strategic and tactical levels.

It discusses several enhanced investigative tools, authorities, and capabilities provided to the FBI through post-9/11 legislation, such as the USA PATRIOT Act of 2001; the 2008 revision to the Attorney General's Guidelines for Domestic FBI Operations (Mukasey Guidelines); and the expansion of Joint Terrorism Task Forces (JTTF) throughout the country; intelligence reform within the FBI and concerns about the progress of those reform initiatives; the FBI's proactive, intelligence-driven posture in its terrorism investigations using preventative policing techniques such as the "Al Capone" approach and the use of agent provocateurs; and the implications for privacy and civil liberties inherent in the use of preventative policing techniques to combat terrorism.
