Book excerpt: This is the first book to address and review the United Nations' Declaration on the Rights of Peasants and Other People Working in Rural Areas (UNDROP), which was adopted by the United Nations General Assembly in December 2018. Food security and sustainable agri-food systems, responsible governance of natural resources, and human rights are among the key themes of the new millennium. The Declaration is the first internationally negotiated instrument bridging these issues, calling for a radical paradigm change in the agricultural sector while giving voice to peasants and rural workers, recognised as the drivers of more equitable and resilient food systems. The book unfolds the impact of the Declaration in the wider realm of law and policy making, especially concerning the new human rights standards related to access and control of natural resources and the governance of food systems. The chapters in the book touch on a broad array of topics, including women’s rights, the role of and impact on indigenous peoples, food sovereignty, climate change, land tenure, and agrobiodiversity. Voices from outstanding scholars and practitioners are gathered together to inform and trigger a further debate on the negotiation process, the innovative and potentially disruptive contents, the relations with other fields of law, and the practical scope of the Declaration. The volume concludes with a collection of case studies that provide concrete examples to help us understand the potential impacts of the Declaration at regional, national, and local levels. This book is the first comprehensive tool to navigate the Declaration and is designed for students, researchers, and practitioners in the fields of food and agriculture law, peasant, agrarian and rural studies, human rights and environmental law, and international development and cooperation. Book excerpt: The development of commercial seed breeding, separate from farming, has resulted in putting itno jeopardy the livelihoods of traditional, small-scale subsistence driven farmers. These commercial seed breeders are protected by intellectual property rights which have resulted in granting monopoly privileges to a handful of firms around the globe, in stark contrast to the lack of concrete rights available to traditional farmers. This thesis explores a framework within the human right to food for Farmers' Rights, and analyses whether farmers as producers of food can be considered a component of the right to food and further to what extent this would make a difference when considered under the World Trade Organization's dispute settlement body. It attempts to provide Farmers' Rights with visibility within the international community along the lines of the world attention paid to patents and the right to health which eventually resulted in the Doha Declaration.

It reports on the advances and setbacks of the past fifty years and offers options for the next fifty years. Book excerpt: In May 1967, internationally renowned activist Fannie Lou Hamer purchased forty acres of land in the Mississippi Delta, launching the Freedom Farms Cooperative (FFC). A community-based rural and economic development project, FFC would grow to over 600 acres, offering a means for local sharecroppers, tenant farmers, and domestic workers to pursue community wellness, self-reliance, and political resistance. Life on the cooperative farm presented an alternative to the second wave of northern migration by African Americans--an opportunity to stay in the South, live off the land, and create a healthy community based upon building an alternative food system as a cooperative and collective effort. Freedom Farmers expands the historical narrative of the black freedom struggle to embrace the work, roles, and contributions of southern Black farmers and the organizations they formed. Whereas existing scholarship generally views agriculture as a site of oppression and exploitation of black people, this book reveals agriculture as a site of resistance and provides a historical foundation that adds meaning and context to current conversations around the resurgence of food justice/sovereignty movements in urban spaces like Detroit, Chicago, Milwaukee, New York City, and New Orleans.

Book excerpt: Taking as a starting point that hunger results from social exclusion and distributional inequities and that lasting, sustainable and just solutions are to be found in changing the structures that underlie our food systems, this book examines how law shapes global food systems and their ongoing transformations. Using detailed case studies, historical mapping and legal analysis, the contributors show how various actors (farmers, civil society groups, government officials, international bodies) use or could use different legal tools (legislative, jurisprudential, norm-setting) on various scales (local, national, regional, global) to achieve structural changes in food systems. Section 1, Institutionalizing New Approaches, explores the possibility of institutionalizing social change through two alternative visions for change – the right to food and food sovereignty. Individual chapters discuss Vía Campesina’s struggle to implement food sovereignty principles into international trade law, and present case studies on adopting food sovereignty legislation in Nicaragua and right to food legislation in Uganda. The chapters in Section 2, Regulating for Change, explore the extent to which the regulation of actors can or cannot change incentives and produce transformative results in food systems. They look at the role of the state in regulating its own actions as well as the actions of third parties and analyze various means of regulating land grabs. The final section, Governing for Better Food Systems, discusses the fragmentation of international law and the impacts of this fragmentation on the realization of human rights. These chapters trace the underpinnings of the current global food system, explore the challenges of competing regimes of intellectual property, farmers rights and human rights, and suggest new modes of governance for global and local food systems. The stakes for building better food systems are high. Our current path leaves many behind, destroying the environment and entrenching inequality and systemic poverty. While it is commonly understood that legal structures are at the heart of food systems, the legal academy has yet to make a significant contribution to recent discussions on improving food systems - this book aims to fill that gap.

Book excerpt: Ever since the homo-sapiens began to use land for creating means of sustenance like food, clothing and shelter, the importance of land as a crucial input in the development of human civilization was realized. Besides, the settlement of people, after nomadic life, also brought into focus the relevance of agricultural land for their survival and development. With the passage of time, the position of the farmer became most vulnerable and pitiable which needed protection at the societal level through the instrument of law. After the Second World War, with the growth of international trade, many new doctrines and concepts were evolved and propagated. Among these, the concept of Intellectual Property, though evolved in the 19th century, witnessed increased recognition and acceptance in the global community. One of the aspects of the Intellectual Property Rights (IPRs) was the protection of breeders' rights. The plant breeders were given protection and many international conventions were convened for this purpose. The International Undertaking on Plant Genetic Resources (IU), the Convention on Biological Diversity, TRIPs Agreement and International Treaty on Plant Genetic Resources for Food and Agriculture, 2001 are four important international conventions that are relevant to the construction of ownership and control of plant genetic resources in global debates on plant variety protection. After according protection to plant breeders, it was soon realized that the rights of the breeders were in conflict with those of farmers. As a result, the concept of farmer's rights was put forth both at international and national levels.

While acknowledging that the World Trade Organization's 1994 Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) sets high standards or protection, the chapter nevertheless argues that there are several provisions of the TRIPS Agreement that states should make use of in order to expand their policy space, and thereby better ensure the rights of food producers. The Indian Protection of Plant Varieties and Farmers' Rights Act of 2001 provides the most interesting example, but there are also other examples. Farmers' rights are still an emerging issue within international law, and states are not subject to detailed requirements in order to realize farmers' rights in the 2001 International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA). Other provisions of the ITPGRFA are, however, also instrumental in order to promote farmers' rights. The right to food was recognized in the 1966 International Covenant on Economic, Social and Cultural Rights, but this human right has been much ignored in policies and decision-making. It is only recently that tools have been developed in order to advise states on how to best promote the realization of the right to food, including when states are negotiating trade and investment agreement, most of which have separate chapters on intellectual property protection.
