It is embodied in the Immigration and Nationality Act (INA), which specifies numerical limits for five family-based admission categories, as well as a per-country limit on total family-based admissions. This book provides an examination of family-based immigration policy. In doing so, it outlines a brief history of U.S. family-based immigration policies, discusses current law governing admissions, and summarises recommendations made by previous congressionally mandated committees charged with evaluating immigration policy. The Immigration and Nationality Act (INA) also includes provisions to assist foreign nationals who have been victims of domestic abuse. These provisions, initially enacted by Congress with the Immigration Act of 1990 and the Violence Against Women Act (VAWA) of 1994, afford benefits to abused foreign nationals and allow them to self-petition for lawful permanent resident (LPR) status independently of the U.S. citizen or LPR relatives who originally sponsored them. Despite the increasing numbers of domestic violence cases, battered immigrant women lack the political advocacy necessary to address the issue decisively. A crucial step to achieve this is increasing and improving the financial and personnel support for immigrant organizations (IO) and existing services for domestic violence survivors. Violence and abuse against women can practically occur in all places and in all situations they encounter in their daily lives. Typical ways to classify these acts of violence are based on the location where the violent act takes place, the identity of the perpetrator(s), or their motives. Accordingly, one can distinguish between domestic violence, violence in public spaces, or violence at the workplace, as well as between violence by (intimate) partners, family members, work contacts, authority figures, or strangers. When violence and abuse occur solely because of a woman’s female identity, it is referred to as misogynistic violence or in extreme cases, femicide, which is the intentional killing of women for the sole reason that they are women. The source of domestic violence against women is not always the intimate partner, it can also involve fathers, brothers, or other household members. Nonetheless, intimate partner violence constitutes the overwhelming majority of domestic violence cases against women and serves as basis of the definition provided by the U.S. Department of Justice.

Today, about one-quarter of the U.S. population consists of immigrants or the children of immigrants. Given the sizable representation of immigrants in the U.S. population, their health is a major influence on the health of the population as a whole. On average, immigrants are healthier than native-born Americans. Yet, immigrants also are subject to the systematic marginalization and discrimination that often lead to the creation of health disparities. To explore the link between immigration and health disparities, the Roundtable on the Promotion of Health Equity held a workshop in Oakland, California, on November 28, 2017. This summary of that workshop highlights the presentations and discussions of the workshop.

Although the conventional wisdom holds that family law is state law, federal immigration law actually regulates marriages that involve immigrants much more extensively than state family does, often unintentionally. This Article maps the architecture of federal immigration law regulation through the four stages of marriage: courtship, entry into marriage, the intact marriage, and exit from marriage through divorce. It shows how laws that appear at first glance to effectuate immigration policy - including the immigration provisions of the Violence Against Women Act, the requirement that citizen spouses sign an affidavit of support in order to sponsor their immigrant spouses, and immigration laws prohibiting marriage fraud - all regulate the creation and dissolution of legally recognized family relationships, and/or determine the legal rights and responsibilities of family members, in other words, function as family law. It then offers ways of analyzing whether Congress is acting within its immigration power when it passes laws that regulate the family.
