Book excerpt: In the aftermath of the Liberian civil war, groups of ex-combatants seized control of natural resource enclaves in the rubber, diamond, and timber sectors. With some of them threatening a return to war, these groups were widely viewed as the most significant threats to Liberia's hard-won peace. Building on fieldwork and socio-historical analysis, this book shows how extralegal groups are driven to provide basic governance goods in their bid to create a stable commercial environment. This is a story about how their livelihood strategies merged with the opportunities of Liberia's post-war political economy. But it is also a context-specific story that is rooted in the country's geography, its history of state-making, and its social and political practices. This volume demonstrates that extralegal groups do not emerge in a vacuum. In areas of limited statehood, where the state is weak and political authority is contested, where rule of law is corrupted and government distrust runs deep, extralegal groups can provide order and dispute resolution, forming the basic kernel of the state. This logic counters the prevailing 'spoiler' narrative, forcing us to reimagine non-state actors and recast their roles as incidental statebuilders in the evolutionary process of state-making. This leads to a broader argument: it is trade, rather than war, that drives contemporary statebuilding. Along the way, this book poses some uncomfortable questions about what it means to be legitimately governed, whether our trust in states is ultimately misplaced, whether entrenched corruption is the most likely post-conflict outcome, and whether our expectations of international peacebuilding and statebuilding are ultimately self-defeating.

Book excerpt: The analysis is theoretically grounded on the empirical definition of a state in terms of Mitchell ( 1991) and the underlying social rules of the Liberian governance systems. The thesis argues that securitisation, debt servicing and revenue collection from extractive industries, were prioritized to create an enabling environment to advance concessionary economic policy. While state-building is apparently technocratic, it is, in fact, inherently political. The identification of domestic actors suggests that access to state institutions, information and thus to decision making was unevenly distributed with preference being given to those proclaimed to be reformist partners in neoliberal state-building. This set of elites has appropriated state-building projects to shape institutional arrangements to its own advantage. Historically, Liberia has been characterized as a 'quasi-apartheid' state with a perpetual lack of social development. Through concession agreements the state outsources public service provision to concessionaires. The Liberian state has never extended its institutions, public service provision and rule of law to its entire territory, yet maintains a monopoly over the country's natural resources. After a decade of international state-building, the constitutional reform process revealed that Liberians value economic rights over political rights. The thesis concludes that low confidence in the state's authority, including in its right to resources, perpetuates the fragile security situation.

Natural resources are essential to sustaining people and peace in post-conflict countries, but governance failures often jeopardize such efforts. This book examines the theory, practice, and often surprising realities of post-conflict governance, natural resource management, and peacebuilding in fifty conflict-affected countries and territories. It includes thirty-nine chapters written by more than seventy researchers, diplomats, military personnel, and practitioners from governmental, intergovernmental, and nongovernmental organizations. The book highlights the mutually reinforcing relationship between natural resource management and good governance. Natural resource management is crucial to rebuilding governance and the rule of law, combating corruption, improving transparency and accountability, engaging disenfranchised populations, and building confidence after conflict. At the same time, good governance is essential for ensuring that natural resource management can meet immediate needs for post-conflict stability and development, while simultaneously laying the foundation for a sustainable peace. Drawing on analyses of the close relationship between governance and natural resource management, the book explores lessons from past conflicts and ongoing reconstruction efforts; illustrates how those lessons may be applied to the formulation and implementation of more effective governance initiatives; and presents an emerging theoretical and practical framework for policy makers, researchers, practitioners, and students. The problem of corruption has become increasingly important in war to peace transitions, eroding confidence in new democratic institutions, undermining economic development, diverting scarce public resources, and reducing the delivery of vital social services. Conflict-affected countries offer an ideal environment for pervasive corruption. Their weak administrative institutions and fragile legal and judicial systems mean that they lack the capacity to effectively investigate and punish corrupt behaviour. In addition, the sudden inflow of donor aid into post-conflict countries and the desire of peacebuilding actors (including the UN, the international financial institutions, aid agencies, and non-governmental organisations) to disburse these funds quickly, create incentives and opportunities for corruption. While corruption imposes costs and compromises on peacebuilding efforts, opportunities for exploiting public office can also be used to entice armed groups into signing peace agreements, thus stabilising post-war environments. This book explores the different functions of corruption both conceptually and through the lens of a wide range of case studies. It also examines the impact of key anti-corruption policies on peacebuilding environments. The dynamics that shape the relationship between corruption and the political and economic developments in post-conflict countries are complex. This analysis highlights that fighting corruption is only one of several important peacebuilding objectives, and that due consideration must be given to the specific social and political context in considering how a sustainable peace can be achieved. Book excerpt: The book explores the right to free, prior and informed consent (FPIC) – a highly controversial right. It is mainly discussed in the context of large-scale business projects on Indigenous territories but also with respect to the creation of protected areas and communities’ traditional resource rights. From a legal anthropological perspective, it attempts to disentangle the various coexisting understandings of FPIC and provide an explanation for the multiplicity of FPIC norms or – to put it in other words – its fragmentation. It examines the right- or stakeholders of FPIC, the scope of the consent requirement, the respect for self-determined decision-making, and the right to FPIC of women in different sociolegal fields. Moreover, it explores the impact of power relations, strategic alliances, and discourses within these fields and shows that the emerging FPIC norms are the result of norm negotiation processes. The fields that are examined include transnational law – more specifically, human rights, environmental, and development law -, the Liberian post-conflict forest and land legislation, and Liberian community forests as fields in which FPIC is operationalized. Liberia is quite unique in this respect. It is not only one of the few countries in Africa recognizing FPIC but has also begun implementing it. The book shows that based on the logic of a sociolegal field, legal identities are discursively created and determine the meaning of FPIC. Moreover, different actors can resort to different legalities shaping the emerging FPIC norm.

While land remains a key resource at the core of many contemporary civil wars, the impact of high-intensity armed violence on the formation of agrarian capitalism is seldom discussed. Drawing on nearly 200 interviews, archival research, and geographical data, this book examines land grabbing and the role of violence in capital with a particular focus on one key actor in the Colombian civil war: paramilitary militias. This book demonstrates how the intricate ties between armed conflict and economy formation are obscured by the widespread belief that violence is a radical form of action, breaking with the normal course of society and disconnected from the legal economy. Under this view, dispossession is perceived as diametrically opposed to capitalist accumulation. This belief is enormously influential in precisely those bureaucratic agencies that are in charge of peacebuilding, both domestically and internationally. However, this narrow view of the relationship between armed violence and capitalism belies the close ties between plunder and lawful profit, and obscures the continuity between violent dispossession and the free market. By the same token, it legitimizes post-war inequality in the name of capitalist development. The book concludes by arguing that the promotion of radical democracy in the government of land and rural development emerges as the only reasonable path for pacifying a violent polity. The book is essential reading for students, scholars, and development aid practitioners interested in land and resource grabbing, agrarian capitalism, civil wars, and conflict resolution.
