It combines the points of view of Japanese and French academics and practitioners, including personnel at several governmental institutions and private companies. Presenting the results of a collaboration between Japanese and French academics, it contributes to the development of a new debate on export control. Although export control has been discussed within the framework of international law in terms of peace and security, its scope has now been expanded to international economic law (i.e., WTO law and international investment law). This means that in order to discuss export control appropriately, the two areas of law have to be combined. At the same time, this topic is not only academic and theoretical but touches upon very real and practical aspects of trade, export, and foreign investment. When we tighten embargos and economic sanctions for anti-terrorism or anti-nuclearization purposes, we encounter more and more cases of conflict between security and the liberalization of economic relations in the world. For this reason, a wide range of collaborative work is needed in this area. This timely book addresses various aspects of the current export control debate.

In particular, this book analyzes and evaluates the effectiveness of export controls in delaying the acquisition of militarily sensitive high technology by the Soviet Union and its allied states. Furthermore, the question of whether or not U.S. economic competitiveness in various high-technology sectors has been unduly undermined by export controls is also evaluated. Numerous official government studies and reports, supplemented by a host of interviews with government officials, businesspeople, and analysts in the United States and Europe are utilized in drawing conclusions and posting policy recommendations. The consequences for export control policy of the revolutionary political upheavals in Eastern Europe and the former U.S.S.R. are also addressed. The study concludes that the strategic/security goal of utilizing controls to hinder and delay the acquisition of militarily significant high technology by the former Soviet Union and its allied states was generally effective. More controversially McDaniel argues that export controls per se have not been a significant determinant of lagging U.S. competitiveness in high technology. However, this conclusion is qualified by the observation that while overall trends in U.S. high-technology exports to important trading partners do not suggest that controls by themselves have unduly hurt U.S. exporters, individual sectors and small firms may be disadvantaged. Finally, the study cautions that U.S. policy must adapt or risk becoming outmoded and increasingly ineffective. This book will be of interest to scholars and students of international relations, international political economy, and international business.

The DHS is responsible for the domestic security implications of threats to the United States posed, in part, through the global networks of which the United States is a part. While the security of the U.S. air transportation network could be increased if it were isolated from connections to the larger international network, doing so would be a highly destructive step for the entire fabric of global commerce and the free movement of people. Instead, the U.S. government, led by DHS, is taking a leadership role in the process of protecting the global networks in which the United States participates. These numerous networks are both real (e.g., civil air transport, international ocean shipping, postal services, international air freight) and virtual (the Internet, international financial payments system), and they have become vital elements of the U.S. economy and civil society. Book excerpt: This report identifies and assesses the role that national law enforcement actors and public prosecutors in the EU member states play in helping prevent the proliferation of weapons of mass destruction (WMD) by stopping the illicit trade in dual-use items. In the 1980s and 1990s, some EU member states discovered cases of illegal trade in sensitive items for use in, for example, the Pakistani nuclear weapon programme. The report discusses how these cases were dealt with in these countries, using a case study model. Acknowledging that dual-use goods are subject to the free movement of goods within the EU, the report emphasizes the importance of coordinating customs and licensing standards among the EU member states to prevent abuse of the EU market for 'licence shopping'. It also presents the argument for the coordination of prosecution and penalties for offenders. In order to show the level of coordination that is required, the report provides an overview of both the international, EU and national legal frameworks for control of the export of dual-use goods.
