The penaltiesimposed by export laws and regulations are severe. Additionally, the privilege ofexporting can be withdrawn from firms or individuals who have violated theregulations, either for specified periods or indefinitely. Book excerpt: The United States, as we all know, is the world's largest exporter of goods and services, and our trade relationships as well as our leadership in science, engineering and manufacturing support between them tens of millions of good-paying American jobs. Alarmingly, our competitive edge is increasingly under attack by policies from China and Russia and from others that seek to obtain advanced technologies and intellectual property by hook or by crook. As some may recall, in 2011 this committee held a hearing on China's "indigenous innovation" policy and at that time I noted the Chinese Government has been turning up the pressure on U.S. and other foreign business to share sensitive technology with Chinese state-owned enterprises as the cost of selling in the Chinese market. This is especially true today. Making matters worse, our outdated regulatory safeguards have potential gaps. Those gaps could permit transfers to potential adversaries of the "know-how" essential to sensitive emerging technologies like artificial intelligence as well as robotics. In this global economy, turning inward is not the solution to these challenges. But we also cannot allow others to cheat U.S. employers or, worse, use our sensitive technology to undermine our own national security.

Book excerpt: Non-tariff measures are generally defined as policy measures other than ordinary customs tariffs that can potentially have an economic effect on international trade in goods, changing quantities traded, or prices or both. Since this definition is broad, a detailed classification is of critical importance so as to better identify and distinguish among the various forms of non-tariff measures. The classification of non-tariff measures presented here is a taxonomy of all those measures considered relevant in international trade today. It builds on an old UNCTAD classification known as the Coding System of Trade Control Measures and was developed by several international organizations forming what is called the MAST group (Multi-Agency Support Team) set up to support the Group of Eminent Persons on Non-tariff Barriers established by the Secretary General of UNCTAD in 2006. The MAST team discussed and proposed this classification, and is composed of: FAO, IMF, ITC, OECD, UNCTAD, UNIDO, World Bank and WTO. The classification is seen as evolving and should adapt to the reality of international trade and data collection needs.
