Book excerpt: An urgent exposition of the pervasive human trafficking that lies just beneath the surface of the US economy—from the stories of its survivors The years of the COVID-19 pandemic have brought to light the exploitation of workers. In this moment of heightened visibility, Unbroken Chains demands that readers examine the hidden sector of American trafficked labor and understand its prevalence across our economy. Drawing from nearly two decades of research on US and international human trafficking, Melissa Hope Ditmore sets forth the harrowing stories of human trafficking survivors and grounds their accounts in the long history of US indentured servitude, looking to its iterations in chattel slavery, Chinese contract labor, and prison labor. In this groundbreaking investigation of American trafficking, Ditmore unveils the unnerving reality that forced labor permeates many industries beyond sex work: in almost every aspect of consumption, people who create our everyday necessities are working amid inescapable exploitation, often without pay. Unbroken Chains tells these workers’ stories: They are nannies for New York City’s diplomatic elites and door-to-door magazine salespeople in the American South. A trafficked person may have harvested your produce, sewn your clothes, or cleaned your apartment lobby. Ditmore offers readers an illuminating window on the world of forced labor, which exists within our own, and a road map for participating in its destruction. Unbroken Chains will include more than a dozen images, including detailed maps, archival pictures, and trafficking documents. Among these images are a modern map of the Sonoran Desert in the American Southwest, a bill of sale for an enslaved woman forced into sex work, letters from men in compulsory plantation labor after the Civil War, and 19th-century “white slave” panic propaganda.

Available in PDF, EPUB and Kindle. Book excerpt: When we consider the concept of sexual abuse and harassment, our minds tend to jump either towards adults caught in unhealthy relationships or criminals who take advantage of children. But the millions of maturing teenagers who also deal with sexual harassment can fall between the cracks. When it comes to sexual relationships, adolescents pose a particular problem. Few teenagers possess all of the emotional and intellectual tools needed to navigate these threats, including the all too real advances made by supervisors, teachers, and mentors. In Sexual Exploitation of Teenagers, Jennifer Drobac explores the shockingly common problem of maturing adolescents who are harassed and exploited by adults in their lives. Reviewing the neuroscience and psychosocial evidence of adolescent development, she explains why teens are so vulnerable to adult harassers. Even today, in an age of increasing public awareness, criminal and civil law regarding the sexual abuse of minors remains tragically inept and irregular from state to state. Drobac uses six recent cases of teens suffering sexual harassment to illuminate the flaws and contradictions of this system, skillfully showing how our current laws fail to protect youths, and offering an array of imaginative legal reforms that could achieve increased justice for adolescent victims of sexual coercion.

Available in PDF, EPUB and Kindle. Book excerpt: Pimp-controlled sex workers, exploited migrants, domestic servants, and sex trafficking of runaway and homeless youth are just a few of the many forms of sex trafficking and labor trafficking going on all around the world-including in the United States. This book exposes both well-known and more obscure forms of human trafficking, documenting how these heinous crimes are encountered in our daily lives. What types of human trafficking crimes are being committed here in the United States? Who are the victims of traffickers? How do we all unknowingly consume the services and products of slavery? And why are human traffickers able to maintain their illicit operations with relative impunity-indeed, with less than .01 percent of human traffickers ever being held accountable for their crimes? Hidden in Plain Sight: America's Slaves of the New Millennium documents how human trafficking and its byproducts touch every community in America, from impoverished inner-city neighborhoods to middle-class suburbs and alcoves of wealthy estates. It presents information derived from narrative accounts of real-life trafficking cases, interviews with convicted human traffickers, empirical research, and criminal case files to expose the grim realities of human trafficking in America, perpetrated by Americans. Readers will grasp the origins, evolution, and extent of the problem; understand how trafficking plays an unrecognized role in our day-to-day lives; and see why advancements in awareness and anti-trafficking resources have not changed the status quo. The victims of trafficking continue to be criminalized by law enforcement, and the offenders continue to exploit and profit from new recruits. This book equips readers with the knowledge needed to identify human trafficking cases and advocate for policy changes to end this scourge in America.

Book Vulnerable Adults and the Law

  • Author : Jonathan Herring
  • Publisher : Oxford University Press
  • Release : 2016-01-22

Download or read book Vulnerable Adults and the Law written by Jonathan Herring and published by Oxford University Press. This book was released on 2016-01-22 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are used to thinking that most people have the capacity to make their own decisions; that they should be free to decide how to live their lives; and that it is a good thing to be self-sufficient. However, in an examination of the legal position of vulnerable adults, understood as those who have capacity under the Mental Capacity Act 2005 but are deemed impaired through vulnerability in their exercise of decision making powers, Jonathan Herring challenges that assumption. Drawing on feminist and disability perspectives he argues that we are all in fact, 'vulnerable' and we need to replace the competent, able-bodied, independent person as the norm which the law is based on and instead fashion which recognises our interdependence and mutuality. At the heart of the law is a distinction between those who have capacity and those who do not. Those who have capacity are given the full rights of the law; they are entitled to enter contracts, dispose of their property, are able to marry. Those who are deemed to lack capacity are unable to make these decisions. Their decisions are made on their behalf based on an assessment of what is in their best interests. This approach is underpinned by the principle of autonomy, and is problematic for those who are deemed 'vulnerable'. The Court of Protection and the Court of Appeal have developed a jurisdiction to deal with cases involving vulnerable adults which has been used in a wide range of cases from those involving people with early stage dementia to cases of forced marriage. This development of law has proved controversial and the courts have struggled to draw its limits and explain the justification for it. Jonathan Herring welcomes the courts willingness to protect vulnerable adults through the inherent jurisdiction, but argues that we need to go much further. It is not just particular groups such as 'the elderly' or 'the disabled' who are vulnerable, but rather vulnerability is part of the human condition. This means that caring relationships are of central significance to our society and should be at the heart of the legal system.
