Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides valuable practical insight into both public supervisory legislation concerning insurance and private insurance contract law in Germany. An informative general introduction surveying the legal, political, financial, and commercial background and surroundings of insurance provides a sound foundation for the specific detail that follows. The book covers all essential aspects of the law and regulation governing insurance policies and instruments. Its detailed exposition includes examination of the form of the insurance company and its reserves and investments; the insurance contract; the legal aspects of the various branches of property and liability insurance; motor vehicle insurance schemes; life insurance, health insurance, and workmen’s compensation schemes; reinsurance, co-insurance, and pooling; taxation of insurance; and risk management and prevention. Succinct yet eminently practical, the book will be a valuable resource for lawyers handling cases affecting Germany. It will be of practical utility to those both in public service and private practice called on to develop and to apply the laws of insurance, and of special interest as a contribution to the much-needed harmonization of insurance law.

Book The Law of Insurance Warranties

Download or read book The Law of Insurance Warranties written by Alastair Owen and published by Taylor & Francis. This book was released on 2021-06-21 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book provides a detailed review of efforts to reform the law on insurance warranties in Australia, New Zealand and the UK, arguing that none of these have been successful. The text proposes a radical new approach to reform of this area of the law, demonstrating through detailed stress testing of these proposals that they would deliver more consistent and equitable outcomes than those achieved to date. Reform of the historically inequitable law of insurance warranties in commercial insurance has been introduced in Australia, New Zealand and, most recently, the UK. This book demonstrates that all these reforms have flaws and that none of them can be relied upon to deliver consistently equitable and predictable outcomes; in particular the UK’s, as yet largely untested, Insurance Act 2015 is shown to have serious flaws that have not previously been identified. Building on lessons from these three jurisdictions, the book sets out an alternative approach for dealing with breaches of insurance warranties and demonstrates that this would consistently deliver better outcomes than any of the existing attempts at reforming this area of the law. Providing an unprecedented multi-jurisdictional review of the law on insurance warranties and in particular the treatment of warranties in the Insurance Act 2015, as well as outlining an innovative and radical alternative approach to reform, the book will be of considerable interest and value to practitioners, academics and students, as well as to other common law jurisdictions contemplating reform of this area of the law.

Book Construction Accident Law

Download or read book Construction Accident Law written by Marc M. Schneier and published by American Bar Association. This book was released on 1999 with total page 742 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty years ago, there were 2500 lawyers in China, basically no legal system, and law schools and law libraries had either been closed or destroyed. It was one of the poorest countries in the world with an adult literacy rate of one-third. Today, illiteracy has dropped to below 10 per cent, consumption has more than doubled, and China has exploded as a major economic force in the global community, with the USA alone investing billions of dollars, aside from pursuing an increasing number of untapped markets. Now with more than 100,000 lawyers and mandated Rule of Law, China has enacted a multitude of new laws, regulations, and orders that must be understood if one wants to do any kind of foreign investment or trade in that country. This work is a guide to the complex laws of China. It opens with a survey of the historical development of China's contemporary legal system, and provides a summary of Chinese legislative and regulatory institutions and their functions. It also gives an overview of the judiciary and the many forces affecting China's evolving legal system.

Book Data Profiling and Insurance Law

Download or read book Data Profiling and Insurance Law written by Brendan McGurk and published by Bloomsbury Publishing. This book was released on 2019-03-21 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: The winner of the 2020 British Insurance Law Association Book Prize, this timely, expertly written book looks at the legal impact that the use of 'Big Data' will have on the provision – and substantive law – of insurance. Insurance companies are set to become some of the biggest consumers of big data which will enable them to profile prospective individual insureds at an increasingly granular level. More particularly, the book explores how: (i) insurers gain access to information relevant to assessing risk and/or the pricing of premiums; (ii) the impact which that increased information will have on substantive insurance law (and in particular duties of good faith disclosure and fair presentation of risk); and (iii) the impact that insurers' new knowledge may have on individual and group access to insurance. This raises several consequential legal questions: (i) To what extent is the use of big data analytics to profile risk compatible (at least in the EU) with the General Data Protection Regulation? (ii) Does insurers' ability to parse vast quantities of individual data about insureds invert the information asymmetry that has historically existed between insured and insurer such as to breathe life into insurers' duty of good faith disclosure? And (iii) by what means might legal challenges be brought against insurers both in relation to the use of big data and the consequences it may have on access to cover? Written by a leading expert in the field, this book will both stimulate further debate and operate as a reference text for academics and practitioners who are faced with emerging legal problems arising from the increasing opportunities that big data offers to the insurance industry.

Book Risk and Insurance in Construction

Download or read book Risk and Insurance in Construction written by Nael G. Bunni and published by Routledge. This book was released on 2003-09-02 with total page 506 pages. Available in PDF, EPUB and Kindle. Book excerpt: Those involved in construction have to cope with so much learning in their own discipline that they shun further involvement in subjects such as insurance and law which in themselves are so deeply and intensely complex. However, insurance and law are interwoven in the basic procedures used in the construction industry for undertaking work, be they design, construction, supervision or operation, or any combination of them. This thoroughly revised edition of Nael Bunni's successful book, formerly called Insurance in Construction, provides information on risk, construction law and construction insurance for those involved with all aspects of construction. The chapters on risk have been expanded to include recent developments in the area and provide further examples of events which could occur on what can be viewed as the most risky human work activity, namely construction. New chapters are also added to deal with the insurance clauses of the many new standard forms of contract published in recent years, including FIDIC's new suite of contracts published in September 1999, ICE's seventh edition of the civil engineering standard form of contract, and ICE's second edition of the design/build form.
