Book excerpt: El trabajo que se presenta a continuación se encarga de analizar el accidente in itinere en España, tanto su evolución histórica como su regulación vigente. Concebido como una modalidad de accidente de trabajo, fue incorporado en nuestro ordenamiento por vía jurisprudencial. En la actualidad el accidente de trabajo in itinere se encuentra regulado en el art. 156.2.a, del Real Decreto Legislativo 8/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley General de la Seguridad Social.Originariamente, este tipo de accidentes laborales, que son los más comunes entre los accidentes asociados al tráfico, solo daba cobertura al trabajador por cuenta ajena dejando fuera de su regulación al trabajador autónomo, sin embargo desde el 24 de octubre de 2017 tras la aprobación de la Ley de Reformas Urgentes del TrabajoAutónomo y de su ámbito subjetivo estos últimos entran dentro de la protección del accidente in itinere.Además se analizan en el trabajo los diferentes requisitos genéricos y específicos, así como las diferencias fundamentadas que este tipo de accidente tiene con respecto al accidente en misión. También se intenta mostrar el alcance de la responsabilidad empresarial y los diferentes planes de movilidad que una empresa puede llevar a cabo para reducir este tipo de accidentes entre sus trabajadores, sin olvidar el análisis de los supuestos que no tiene la consideración de accidente in itinere.
