It draws together work exploring how evidence is used or mis-used during the legal process, and re-used after the law’s work has concluded by engaging with ethical, aesthetic or emotional dimensions of using law’s evidence. Within socio-legal discourse, the move towards ‘open justice’ has emerged concurrently with a much broader cultural sensibility, one that has been called the "archival turn" (Ann Laura Stoler), the "archival impulse" (Hal Foster) and "archive fever" (Jacques Derrida). Whilst these terms do not describe exactly the same phenomena, they collectively acknowledge the process by which we create a fetish of the stored document. The archive facilitates our material confrontation with history, historicity, order, linearity, time and bureaucracy. For lawyers, artists, journalists, publishers, curators and scholars, the document in the archive has the attributes of authenticity, contemporaneity, and the unique tangibility of a real moment captured in material form. These attributes form the basis for the strict interpretive limits imposed by the rules of evidence and procedure. These rules do not contain the other attributes of the archival document, those that make it irresistible as the basis for creative work: beauty, violence, surprise, shame, volume, and the promise that it contains a tantalising secret. During the criminal trial, evidentiary material is tightly regulated; it is formally regarded as part of the court record, and subject to the rules of evidence and criminal procedure. However, these rules and procedures cannot govern or control this material after proceedings have ended. In its ‘afterlife’, criminal evidence continues to proliferate in cultural contexts. It might be photographic or video evidence, private diaries and correspondence, weapons, physical objects or forensic data, and it arouses the interest of journalists, scholars, curators, writers or artists. Building on a growing cultural interest in criminal archival materials, this book shows how in its afterlife, criminal evidence gives rise to new uses and interpretations, new concepts and questions, many of which are creative and transformative of crime and evidence, and some of which are transgressive, dangerous or insensitive. It takes the judicial principle of open justice – the assumption that justice must be seen to be done – and investigates instances in which we might see too much, too little or from a distorted angle. It centres upon a series of case studies, including those of Lindy Chamberlain and, more recently, Oscar Pistorius, in which criminal evidence has re-appeared outside of the criminal process. Traversing museums, libraries, galleries and other repositories, and drawing on extensive interviews with cultural practitioners and legal professionals, this book probes the legal, ethical, affective and aesthetic implications of the cultural afterlife of evidence.

This edited volume provides conceptual critiques of the transitional justice paradigm and innovations in providing a new lens on archival practices in transitional justice. In doing so it offers in-depth analyses of the relationship between archives and transitional justice in France, Colombia, Rwanda, South Africa and Northern-Ireland; it highlights truth commission and (international) court archives as much as personal collections and oral histories. The authors bring critical archival studies into dialogue with transitional justice discourses to highlight the activism and emancipatory potential but also the possibilities of injustices inherent in archives and archival practice. Crucially, the book goes beyond merely highlighting the evidentiary value of archives by linking them to a multitude of transitional justice processes, goals and ideals, including remembrance processes, witnessing, reconciliation, non-recurrence, and various struggles against injustices and prevalent violence. This collection contributes to and expands our understanding of archives in transitional justice and critically questions core assumptions being made about the inherently positive contributions archives and records make to dealing with a violent past. The chapters in this book were originally published as a special issue of The International Journal of Human Rights.

As a landing place for migrants and newcomers, however, it has also been memorably and colorfully represented in the literature of Victorian authors such as Charles Dickens and Oscar Wilde. In Strangers in the Archive, Heidi Kaufman applies the resources of archives both material and digital to move beyond icon and stereotype to reveal a deeper understanding of East End literature and culture in the Victorian age. Kaufman uncovers this engaging new perspective on the East End through Maria Polack’s Fiction without Romance (1830), the first novel to be published by an English Jew, and through records of Polack’s vibrant community. Book excerpt: Documenting Rebellions is a study of four archives that were constituted with a common desire to preserve the memory and evidence of lesbian and gay people. They are The Lesbian Herstory Archives (New York), The ONE National Gay and Lesbian Archives (Los Angeles), the June L. Mazer Lesbian Archives (West Hollywood), and the ArQuives: Canada's LGBTQ2+ Archives (Toronto). Using a narrative approach that draws from first-person accounts and archival research, each chapter tells a story about how these organizations came to exist, who has supported them over time, and how they have survived for more than forty years. This book is the result of a five-year project that began in 2012 and builds on the author's own experience working with lesbian and gay archives. In Documenting Rebellions, Sheffield places lesbian and gay archives in the context of changing political opportunity structures that have afforded a liberal lesbian and gay rights movement some successes while continuing to marginalize intersectional, queer and trans people. The goal of this study is not to critique these organizations, but to show how this cohort of community archives has been affected by the very same combination of socio-political and economic factors that shape the cultural histories that they preserve. Documenting Rebellions consider the material needs of archives - space, money, and expertise - that are sometimes rendered invisible by the idiosyncratically subjective cultural theory model of 'the archive' that has emerged from within interdisciplinary studies. By tracing the emergence and development of these organizations, Sheffield uncovers representational politics, institutional pluralism, generational divides, shifting national politics, interpersonal relationships, and challenges with sustainability, both financial and otherwise. Rebecka Taves Sheffield is an archivist and archival educator based in Hamilton, Ontario. She has taught in graduate programs at Simmons University School of Library and Information Science, for the University of Toronto iSchool, and for Library Juice Academy. Presently, she is a senior policy advisor for the Archives of Ontario and works on digital recordkeeping strategies. Rebecka previously served as the Executive Director for the ArQuives (formerly the Canadian Lesbian and Gay Archives), where she spent the better part of a decade learning as much as possible about Canada's LGBTQ2+ histories. She has studied sociology, gender studies, publishing, and archives. She completed a PhD in information studies and sexual diversity studies at the University of Toronto.
