Book excerpt: Since the Snowden revelations, the adoption in May 2016 of the General Data Protection Regulation and several ground-breaking judgments of the Court of Justice of the European Union, data protection and privacy are high on the agenda of policymakers, industries and the legal research community. Against this backdrop, Data Protection and Privacy under Pressure sheds light on key developments where individuals’ rights to data protection and privacy are at stake. Book Data Privacy and GDPR Handbook

Download or read book Data Privacy and GDPR Handbook written by Sanjay Sharma and published by John Wiley & Sons. This book was released on 2019-11-26 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: The definitive guide for ensuring data privacy and GDPR compliance Privacy regulation is increasingly rigorous around the world and has become a serious concern for senior management of companies regardless of industry, size, scope, and geographic area. The Global Data Protection Regulation (GDPR) imposes complex, elaborate, and stringent requirements for any organization or individuals conducting business in the European Union (EU) and the European Economic Area (EEA)—while also addressing the export of personal data outside of the EU and EEA. This recently-enacted law allows the imposition of fines of up to 5% of global revenue for privacy and data protection violations. Despite the massive potential for steep fines and regulatory penalties, there is a distressing lack of awareness of the GDPR within the business community. A recent survey conducted in the UK suggests that only 40% of firms are even aware of the new law and their responsibilities to maintain compliance. The Data Privacy and GDPR Handbook helps organizations strictly adhere to data privacy laws in the EU, the USA, and governments around the world. This authoritative and comprehensive guide includes the history and foundation of data privacy, the framework for ensuring data privacy across major global jurisdictions, a detailed framework for complying with the GDPR, and perspectives on the future of data collection and privacy practices. Comply with the latest data privacy regulations in the EU, EEA, US, and others Avoid hefty fines, damage to your reputation, and losing your customers Keep pace with the latest privacy policies, guidelines, and legislation Understand the framework necessary to ensure data privacy today and gain insights on future privacy practices The Data Privacy and GDPR Handbook is an indispensable resource for Chief Data Officers, Chief Technology Officers, legal counsel, C-Level Executives, regulators and legislators, data privacy consultants, compliance officers, and audit managers.

Book From Safe Harbour to Privacy Shield

Download or read book From Safe Harbour to Privacy Shield written by Shara Monteleone and published by . This book was released on 2017 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: The CJEU’s Schrems judgment of October 2015, besides declaring the European Commission’s Decision on the EU-US ‘Safe Harbour’ data transfer regime invalid, has also settled a number of crucial requirements corresponding to the foundations of EU data protection. In the assessment of the Privacy Shield, the new framework for EU-US data transfer, these need to be taken into account. In less than one year since the CJEU ruling, the Commission has adopted a new adequacy decision, in which the Privacy Shield regime is deemed to adequately protect EU citizens. The main improvements of the Privacy Shield (over its predecessor), as well as the critical reactions to the new arrangements, are discussed in this analysis, taking into account, however, that an annual review is expected to take place by summer 2017, which will also take into account the coming into effect of the EU General Data Protection Regulation in 2018.

Book GDPR Personal Data Protection in the European Union

Download or read book GDPR Personal Data Protection in the European Union written by Mariusz Krzysztofek and published by Kluwer Law International B.V.. This book was released on 2021-04-07 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: GDPR: Personal Data Protection in the European Union Mariusz Krzysztofek Personal data protection has become one of the central issues in any understanding of the current world system. In this connection, the European Union (EU) has created the most sophisticated regime currently in force with the General Data Protection Regulation (GDPR) (EU) 2016/679. Following the GDPR’s recent reform – the most extensive since the first EU laws in this area were adopted and implemented into the legal orders of the Member States – this book offers a comprehensive discussion of all principles of personal data processing, obligations of data controllers, and rights of data subjects, providing a thorough, up-to-date account of the legal and practical aspects of personal data protection in the EU. Coverage includes the recent Court of Justice of the European Union (CJEU) judgment on data transfers and new or updated data protection authorities’ guidelines in the EU Member States. Among the broad spectrum of aspects of the subject covered are the following: – right to privacy judgments of the CJEU and the European Court of Human Rights; – scope of the GDPR and its key definitions, key principles of personal data processing; – legal bases for the processing of personal data; – direct and digital marketing, cookies, and online behavioural advertising; – processing of personal data of employees; – sensitive data and criminal records; – information obligation & privacy notices; – data subjects rights; – data controller, joint controllers, and processors; – data protection by design and by default, data security measures, risk-based approach, records of personal data processing activities, notification of a personal data breach to the supervisory authority and communication to the data subject, data protection impact assessment, codes of conduct and certification; – Data Protection Officer; – transfers of personal data to non-EU/EEA countries; and – privacy in the Internet and surveillance age. Because the global scale and evolution of information technologies have changed the data processing environment and brought new challenges, and because many non-EU jurisdictions have adopted equivalent regimes or largely analogous regulations, the book will be of great usefulness worldwide. Multinational corporations and their customers and contractors will benefit enormously from consulting and using this book, especially in conducting case law, guidelines and best practices formulated by European data protection authorities. For lawyers and academics researching or advising clients on this area, this book provides an indispensable source of practical guidance and information for many years to come.

Book Guide to the EU U S Privacy Shield

Download or read book Guide to the EU U S Privacy Shield written by and published by . This book was released on 2016 with total page 21 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union (EU) and the United States (U.S.) have strong commercial ties. Transfers of personal data are an important and necessary part of the transatlantic relationship, especially in today's global digital economy. Many transactions involve the collection and use of personal data, for example your name, phone number, birth date, home and email address, credit card number, national insurance or employee number, login name, gender and marital status, or any other kind of information that makes it possible to identify you. For instance, your data may be collected in the EU by a branch or a business partner of an American company which r eceives the data and then uses it in the U.S. This is the case, for instance, when you buy goods or services online, when using social media or cloud storage services, or if you are an employee of an EU-based company that uses a company in the U.S. (e.g. the parent company) to deal with personnel data. EU law requires that when your personal data are transferred to the U.S they continue to benefit from a high level of protection. This is where the EU-U.S. Privacy Shield comes in. The Privacy Shield allows your personal data to be transferred from the EU to a company in the United States, provided that the company there processes (e.g. uses, stores and further transfers) your personal data according to a strong set of data protection rules and safeguards. The protection given to your data applies regardless of whether you are an EU citize n or not.

Download or read book Enforcing Privacy written by David Wright and published by Springer. This book was released on 2016-04-19 with total page 503 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about enforcing privacy and data protection. It demonstrates different approaches – regulatory, legal and technological – to enforcing privacy. If regulators do not enforce laws or regulations or codes or do not have the resources, political support or wherewithal to enforce them, they effectively eviscerate and make meaningless such laws or regulations or codes, no matter how laudable or well-intentioned. In some cases, however, the mere existence of such laws or regulations, combined with a credible threat to invoke them, is sufficient for regulatory purposes. But the threat has to be credible. As some of the authors in this book make clear – it is a theme that runs throughout this book – “carrots” and “soft law” need to be backed up by “sticks” and “hard law”. The authors of this book view privacy enforcement as an activity that goes beyond regulatory enforcement, however. In some sense, enforcing privacy is a task that befalls to all of us. Privacy advocates and members of the public can play an important role in combatting the continuing intrusions upon privacy by governments, intelligence agencies and big companies. Contributors to this book - including regulators, privacy advocates, academics, SMEs, a Member of the European Parliament, lawyers and a technology researcher – share their views in the one and only book on Enforcing Privacy.
