Available in PDF, EPUB and Kindle. Book excerpt: "[This book's] dual coverage of contracts under English law and the CISG is a valuable benefit for those interested in all types of sale of goods contracts, including the sale of commodities. The...commentary provides analysis on decided cases as well as on standard form contracts which represent evolving trade practice. In addition to matters of contract law, the book considers relevant property law, most notably addressing those issues arising out of the use of documents of title, such as marine bills of lading. The rights and duties of buyer and seller are explained in depth, and the relationship of sale contracts to other contracts, such as charter parties and letter of credit contracts, is rigorously examined. The book deals with issues of frustration and force majeure, the passing of property and risk, and remedies. The new edition provides expanded coverage of remedies, the passing of property, and the CISG, and gives even greater focus to the standard form contracts. All important recent decisions are considered and particularly those relating to interpretation and implied terms and the bunkers litigation."--

Download or read book Nature in the New World written by Antonello Gerbi and published by University of Pittsburgh Pre. This book was released on 2010-06-20 with total page 481 pages. Available in PDF, EPUB and Kindle. Book excerpt: Translated by Jeremy Moyle In Nature in the New World (translated into English in 1985), Antonello Gerbi examines the fascinating reports of the first Europeans to see the Americas. These accounts provided the basis for the images of strange and new flora, fauna, and human creatures that filled European imaginations.Initial chapters are devoted to the writings of Columbus, Vespucci, Cortes, Verrazzano, and others. The second portion of the book concerns the Historia general y natural de las Indias of Gonzalo Fernandez de Oviedo, a work commissioned by Charles V of Spain in 1532 but not published in its entirety until the 1850s. Antonello Gerbi contends that Oviedo, a Spanish administrator who lived in Santo Domingo, has been unjustly neglected as a historian. Gerbi shows that Oviedo was a major authority on the culture, history, and conquest of the New World.
Download or read book A Sporting Lexicon of the Fifteenth Century The J B Treatise 2nd revised edition written by David Scott-Macnab and published by Society for the Study of Medieval Languages and Literature. This book was released on 2017-07-15 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: The J.B. Treatise is a collection of lore and information from the later fifteenth century on a range of topics considered essential learning for anyone aspiring to the English gentry. It has hitherto been known principally by way of an eclectic medley of filler material in the printed Boke of St Albans (1486), but survives in numerous variant forms in twenty-two, mostly unrelated, manuscripts. The treatise’s foremost concerns are hawking and hunting, but it differs from other contemporary treatises on these sports by concentrating on terminology rather than praxis. Much of its information is presented in the form of lists of terms, suggesting that it served mainly as a lexical primer rather than a manual of practical instruction. This study – which includes four major variant texts, explanatory notes, a glossary and complete collations of the ‘J.B.’ lists of collective nouns and carving terms – is the first comprehensive survey of all known versions of the J.B. Treatise, whose contents will be of interest to English medievalists in a range of disciplines, including history, literature and linguistics. This second edition of the J.B. Treatise includes comprehensive updates to the introduction, notes, and glossary to account for new scholarship, including numerous emendations to the OED prompted by lexical evidence presented in the first edition (2003). It also incorporates a revised bibliography and references to new editions of medieval texts.

Download or read book The Cosmic Race La Raza Cosmica written by José Vasconcelos and published by JHU Press. This book was released on 1997-08-13 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this influential 1925 essay, presented here in Spanish and English, José Vasconcelos predicted the coming of a new age, the Aesthetic Era, in which joy, love, fantasy, and creativity would prevail over the rationalism he saw as dominating the present age. In this new age, marriages would no longer be dictated by necessity or convenience, but by love and beauty; ethnic obstacles, already in the process of being broken down, especially in Latin America, would disappear altogether, giving birth to a fully mixed race, a "cosmic race," in which all the better qualities of each race would persist by the natural selection of love.
Download or read book Composite Administrative Procedures in the European Union written by Sergio Alonso de León and published by . This book was released on 2017 with total page 430 pages. Available in PDF, EPUB and Kindle. Book excerpt: Composite administrative procedures are procedures in which administrative authorities from the Union and from Member States cooperate and each provide a relevant input into the final administrative decision taken at the Union or the national level. these procedures are becoming more and more frequent as a mechanism for the implementation of Union policies and they reflect a multi-layered system of EU and national administrative cooperation that goes beyond the old paradigm of the indirect implementation of EU Law. Nevertheless, they remain a relatively unexplored topic in European Administrative Law. However positive they may be for building networks of mutual trust between the Union and national administrative actors, and however efficient for the adoption of technically complete and consensual decisions, they raise many legal concerns. After defining these procedures and placing them in context, this ook goes on to identify the legal shortcomings to which they give rise from the perspective of the individual and points towards potential solutions. Composite procedures reflect very well the current state-of-play of European integration with regard to Administrative Law, but the European citizen should not suffer in his legal position owing to their complexit.
Download or read book Religion Secularism and Constitutional Democracy written by Jean L. Cohen and published by Columbia University Press. This book was released on 2015-12-22 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: Polarization between political religionists and militant secularists on both sides of the Atlantic is on the rise. Critically engaging with traditional secularism and religious accommodationism, this collection introduces a constitutional secularism that robustly meets contemporary challenges. It identifies which connections between religion and the state are compatible with the liberal, republican, and democratic principles of constitutional democracy and assesses the success of their implementation in the birthplace of political secularism: the United States and Western Europe. Approaching this issue from philosophical, legal, historical, political, and sociological perspectives, the contributors wage a thorough defense of their project's theoretical and institutional legitimacy. Their work brings fresh insight to debates over the balance of human rights and religious freedom, the proper definition of a nonestablishment norm, and the relationship between sovereignty and legal pluralism. They discuss the genealogy of and tensions involving international legal rights to religious freedom, religious symbols in public spaces, religious arguments in public debates, the jurisdiction of religious authorities in personal law, and the dilemmas of religious accommodation in national constitutions and public policy when it violates international human rights agreements or liberal-democratic principles. If we profoundly rethink the concepts of religion and secularism, these thinkers argue, a principled adjudication of competing claims becomes possible.

Download or read book The Poisoned Water written by Fernando Benítez and published by Carbondale : Southern Illinois University Press. This book was released on 1973 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: This first English translation makes available to English-speaking readers a powerful modern Mexican novel, first published in 1961. Fernando Benítez, well-known Mexican author, journalist, and winner of Mexico's 1968 best-book award, exploits a true but little-known incident by building it into a tightly structured, tense, and tragic novel of social protest. The incident on which the novel is based is a bloody rebellion against the village feudal master touched off by joking comment on the "poisoning" of the water as one of Don Ulises's men is pushed into the plaza fountain. Feeding on itself, the rumor spreads that the "boss" has poisoned the local spring, and rebellion follows, with its violent and unforeseen consequences. The result is a frightening look at one of Mexico's major social problems and glaring ironies--that over fifty years after a revolution fought by the peasant and for the peasant, most rural groups are still living below the national economic standard.
