La respuesta a esta pregunta depende de la definición del concepto de derecho. Cualquier intento de definir un concepto debe partir de un cierto uso del lenguaje, del significado corriente de la palabra con la que nos proponemos designar el concepto. Uno debe ver si los fenómenos sociales llamados «derecho» presentan una característica común que los distinga de otros fenómenos sociales de clase similar, característica que sea lo suficientemente significativa como para constituir un concepto general para la comprensión racional de la vida social.
