Book excerpt: Excerpt from The Federal Constitution: An Essay At this time, the one hundredth anniversary of the adoption of the Federal Constitution, it seems peculiarly fitting that we pause a while, to take a retrospective view, of the interesting scenes which were enacted in that eventful drama, and to contemplate the masterful structure then reared by the wise and inspired men of that remarkable epoch. During the past century, under the benign influence and polity embodied in that beautiful organism, a mighty nation has been established to give the world assurance of the stability and grandeur of the representative system. Book excerpt: Excerpt from Essays on Constitutional Law and Equity, and Other Subjects, Vol. 1 His other favorite subject was Equity. In his hands the traditional dogmas of this classic subject received new life and meaning. In their practical applications to modern problems he took endless satisfaction. Noth ing seemed to give him more of the true scientist's pleas ure than to bring to bear upon some apparently dry and commonplace decision the heavy artillery of Equity's fundamental ideas. In his treatment of such a problem, new dignity was added to it, and the practical importance of a scientific consistency was convincingly revealed. Book Studies in Constitutional Law

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Studies in Constitutional Law: France, England, United States In introducing the book in an English form to readers unable to enjoy the French original, I can confidently recommend it to the attention of students. The work was originally composed for Frenchmen; hence the author occasionally insists upon features in the English Constitution which to Englishmen may appear to be too well known to require notice or explanation. But the fact that the essay is written by a foreigner for foreigners, though it may seem at first sight to limit the utility of the book for: English students, is in reality one of its great recommendations. We all forget to note. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Essays on the Constitution of the United States

Download or read book Essays on the Constitution of the United States written by and published by . This book was released on 2015-07-03 with total page 442 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Essays on the Constitution of the United States: Published During Its Discussion by the People, 1787-1788 In 1888 the editor selected from the pamphlet arguments published during the discussion of the Constitution of the United States, prior to its ratification by the States, a collection of fourteen tracts, and printed them in a volume under the title of Pamphlets on the Constitution of the United States. The reception given that collection clearly proved that these writings were only neglected because of their rarity and inaccessibility, and has induced the editor to collect another, though largely similar class of writings, which he believes of equal value and equally unknown. In the great discussion which took place in the years 1787 and 1788 of the adoption or rejection of the Constitution of the United States, one of the important methods of influencing public opinion, resorted to by the partisans and enemies of the proposed frame of government, was the contribution of essays to the press of the period. The newspapers were filled with anonymous articles on this question, usually the product of the great statesmen and writers of that period. Often of marked ability, and valuable as the personal views of the writers, the dispersion and destruction of the papers that contained them have resulted in their almost entire neglect as historical or legal writings, and the difficulty of their proper use has been further increased by their anonymous character, which largely destroyed the authority and weight they would have carried, had their true writers been known. Book The English Constitution

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The English Constitution: And Other Political Essays The English Constitution, by Mr. Walter Bagehot, has already attracted some attention in this country, but it is a work that deserves to be much more widely and familiarly known. Its title, however, is so little suggestive of its real character, and is so certain to repel and mislead American readers, that, in bringing out a new and cheaper edition of it, at this time, some prefatory words may be useful for the correction of erroneous impressions. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Legal Essays I am fully aware how far my work, even in merely collecting what has already been published, must fall short of what would have come from my father's hand. And I have also had some painful doubts whether he would approve of publishing some of the articles at all in their present form without his revision. But it has seemed to me on the whole that with an explanation, which I have undertaken in each instance to give, of the date and circumstances under which they were written, their publication is justified. I have made no changes in the articles except in the ease of clerical errors and the like, which Professor Thayer had corrected in his own copy. All notes which I have added are enclosed in square brackets. Most of the matter so added, and all which shows the result of study or research, is taken from memoranda of Professor Thayer's on the margin of his copies or in his collections of cases. Book excerpt: Excerpt from The Democracy of the Constitution, and Other Addresses and Essays The first five papers in this volume deal with the Constitution of the United States, with the democ racy which it created and limited, and with the changes in it which are now proposed, affecting the courts and the principles of representative govern ment. I have endeavored to omit, so far as possible, any repetitions, but as all the addresses are concerned with different phases of the same subject there are certain points where the same argument must recur in order to make clear the particular aspect of the question to which the main discussion is devoted. Book excerpt: Excerpt from The Doctrine of Judicial Review, Its Legal and Historical Basis, and Other Essays In the preparation of this little volume I have be come the debtor of Professor Evans Holbrook, editor of the Michigan Law Review, for valuable editorial as sistance in putting the first study into final shape. My especial thanks are also due to Mr. Walter Cottrell of the Princeton University Library staff and Mr. B. A. Finney of the University of Michigan Library for numberless courtesies. I should also take this occasion to point out to the reader that when the word constitution is capi talized in the following pages it refers to the national Constitution, but that at other times it refers to this or that State constitution or signifies constitution in the generic sense. The distinction becomes at times of some importance. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. Download or read book Principles of the Constitutional Law of the United States Classic Reprint written by Westel W. Willoughby and published by Forgotten Books. This book was released on 2015-09-27 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Constitutional Law of the United States This volume is an abridgment of the author's larger treatise in two volumes, published in 1910 under the title The Constitutional Law of the United States. The aim has been to present the general principles of our constitutional jurisprudence in a form suitable for class-room use. In pursuance of this aim care has been taken to cite those cases which not only support the positions stated in the text but which Will best repay individual examination and study by the student. In particular the effort has been made to suggest, and in a measure to discuss, the unsettled questions of our Federal jurisprudence. The necessary limits of space have prevented in many instances an adequate presentation of the arguments supporting the doctrines stated, but, from a pedagogic point of view this may be a merit rather than a defect, for it will furnish opportunity for a presentation by the students of the court's reasoning as gained by a reading of the cases, and a criticism by the instructor of the reasoning as thus pre sented.
