The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.

Book excerpt: L'influence de la notion de chose en droit civil français procure un trouble apparent dont le dénouement ne va pas sans s'accorder sur la définition de la notion même. Elle apparaît sous deux formes possibles, d'abord pour elle-même, et par les effets qu' elle engendre. La première étude décrit l'influence de la notion dans les sources et les domaines du droit civil. Dans les uns, l'influence est "immédiate" et participe à la délimitation du domaine sur lequel elle s'exerce, servant à la fois de fondement et de définition (droit des biens). Dans les autres, l'influence est "médiate" et favorise la délimitation de domaines qui ne lui étaient pas immédiatement réservés (droit des personnes), sous un rapport des concepts vertical ou horizontal. L'influence permet d'esquisser des relations avec des notions qui sont antithétiques, comme elle peut révéler tout son attrait dans les répartitions catégorielles à la frontière de l'avoir et de l'être. Mais elle dérive selon un processus de soumission qui inverse le rapport sujet/personne par lequel la personne est soit réifiée, soit instrumentalisée. La seconde étude a trait à l'influence de la notion de chose dans les méthodes et les effets d'interprétation. Elle intervient ainsi de manière directe lorsque la notion sert la technique d'interprétation et permet de dévoiler un procédé d'objectivation partiel ou complet. Par ailleurs, l'influence dans le raisonnement juridique est indirecte lorsque la notion est utilisée comme moyen d'équilibre juridique soit activement, soit passivement et participe d'un mouvement de patrimonialisation.

In the law of contract he refers to the law of Scotland and the United States, to their advantage in some respects in comparison with English law. But he has a high regard for the English law of torts, which he thinks most strongly justifies the title of his lectures, "The Rational Strength of English Law."
