Book excerpt: The thesis provides a theoretical literature review of a number of approaches to, categories of and different perspectives on environmental rights in general. As part of this review a number of generic elements is identified for the fulfilment of constitutional environmental provisions, generally. The literature review attends also to the notions of local environmental governance and 'local politics of pollution', amongst other concepts related to local government.Secondly, this thesis critically considersthe Constitution or Basic Law of the Federal Republic of Germany, 1949 (Grundgesetz) and relevant developments in Germany with reference to the European context and a local government case study on the municipality of Heidelberg. It considers also the Constitution of Namibia of 1990 and relevant developments in Namibia with reference to the African and Southern African contexts and a case study on the Walvis Bay municipality. The South African position is subsequently analysed, first with a focus on section 24 of the Constitution of the Republic of South Africa, 1996, environmental law and related developments, then shifting the focus to the constitutional provisions on local government, local government law, related developments and the case of the Drakenstein Local Municipality.Thirdly, based on the lessons learned from and lacunae identified in all three of the countriesconsidered, this study concludes with a set of recommendations for the South African context.

The promulgation of the 1996 Constitution of the Republic of South Africa provided for the potential acceleration of the development of South African environmental law jurisprudence. The Constitution grants every person the right to an environment that is not harmful to their health or well-being; as well as the right to have the environment protected through reasonable legislative and other measures that prevent pollution, ecological degradation, promote conservation and secure ecological sustainable development and the use of natural resources while promoting justifiable economic and social development. Environmental law deals with a large number of legal problems at the domestic level (i.e. South Africa), the regional life (i.e. African Union), the sub-regional level (i.e. Southern African Development Community), as well as at an international level (i.e. United Nations). At the domestic level, environmental law draws on all the formal sources of law including legislation, common law principles, customary law, indigenous law and international environmental law. The bulk of South African environmental law and principles are regulated by legislation at national level. The most important environmental legislative measures at a national level include the 1996 South African Constitution and the National Environmental Management Act (NEMA) of 1998. Other additional environmental legislation in South Africa deal with issues such as conservation, pollution (atmospheric, land, marine, noise, water and waste management), energy and energy resources. Book excerpt: C.O.OKIDl1 I welcome the opportunity to prepare a Foreword to the book on Environmental Policy and Law in Africa, edited by Kevin R. Gray and Beatrice Chaytor. It is a pleasure to do that because the book is a contribution to the cause of capacity building for development and implementation of environmental law in Africa, a goal towards which I have had an undivided focus over the last two decades. There is still some belief in and outside Africa that for developing countries in general, and Africa in particular, development and implementation of environmental law is not a priority. This belief prevails strongly in many quarters of the industrialised countries. In fact, the view is held either out of blatant ignorance or by some renegade industrialists who fail to appreciate Michael Royston's 1979 thesis that Pollution Prevention Pays.2 That group, for obvious reasons, must have their correspondent counterparts in Africa to provide hope that industries rejected as derelict in the West or inoperable due to rigorous environmental regulation, can find homes to which they can escape and dump their polluting industries.
