Since that time the advocates of the doctrine of popular consent as the sine qua non of territorial settlements involving changes of sovereignty have endeavored to secure its universal recognition in theory as well as in practice. In the course of the nineteenth century plebiscites have been held in a number of territorial transfers, resulting in changes of sovereignty without, however, establishing the resort to such popular votes as a general practice in international law. In the attempt to form an opinion as to the justification of the employment of a plebiscite in the determination of sovereignty, either as a general principle or as a proper mode of settlement in individual cases, we turn instinctively to the past in search of its precedents illustrating the practice of the nations, and for records of opinions of leading statesmen and international jurists. The present study aims to estimate the evolutionary momentum of the doctrine actually applied, in so far as it is traceable through the mass of alleged or genuine precedents of ancient, feudal, and modern times, and to consider the theoretical and practical aspect of the subject from the point of view of international and constitutional law in the light of more recent developments. The most complete collection of precedents which a review of the bibliography of the subject seems to offer is found in F. Book excerpt: Although referendums have been used for centuries to settle ethnonational conflicts, there has yet been no systematic study or generalized theory concerning their effectiveness. Referendums and Ethnic Conflict fills the gap with a comparative and empirical analysis of all the referendums held on ethnic and national issues from the French Revolution to the 2012 referendum on statehood for Puerto Rico. Drawing on political theory and descriptive case studies, Matt Qvortrup creates typologies of referendums that are held to endorse secession, redraw disputed borders, legitimize a policy of homogenization, or otherwise manage ethnic or national differences. He considers the circumstances that compel politicians to resort to direct democracy, such as regime change, and the conditions that might exacerbate a violent response. Qvortrup offers a clear-eyed assessment of the problems raised when conflict resolution is sought through referendum as well as the conditions that are likely to lead to peaceful outcomes. Book excerpt: The European Scrutiny Committee's report (HCP 1817, ISBN 9780215043665) on the Treaty on Stability, Coordination and Governance (SCG), states that it is impossible to enforce and there are serious concerns over the rule of law, with no concessions for the UK. The Committee also views the SCG Treaty as doing little towards solving the eurozone crisis, except providing some comfort to international markets. It is also possible that the Treaty will prove to be politically impossible to enforce. Some form of breakdown of the eurozone clearly remains possible. The approach taken to proceed with the fiscal compact raises a fundamental question about the application of the rule of law within the EU. The SCG Treaty would have been an EU treaty but for the veto. However, the EU institutions and the governments of the 25 Member States who have signed the Treaty, have embarked on a dangerous precedent in seeking to attain their political objectives irrespective of the rule of law in the EU. The Government has made clear that it has serious reservations about the legality of what has been done, but the question of what it intends to do remains unsatisfactorily unresolved. When looking at the unprecedented letter sent from Sir John Cunliffe, the UK Ambassador to the EU, to the Secretary-General of the Council on 22 February, it appears that the Government does not want to stand in the way of 25 States reinforcing the eurozone, but sees the use of the institutions outside the EU Treaties, without the consent of all 27 Member States, as unlawful, irrespective of the consequences to and the lack of concessions for the United Kingdom and the current failure to take the issue of legality further. To the Committee it therefore seems that the SCG Treaty must be deemed unlawful in the Government's view. Although questions have been raised as to what the UK achieved by the use of its veto, the Committee concludes that the veto was justified because of the very real concerns about a breach of EU law, even if this was not the reason given exclusively for the use of the veto in the first place. The Committee notes that there is an increasing tendency for the EU to propound the virtues of the rule of law but not to apply it in practice.
