Esta obra pretende ofrecer una exposición detallada de las sentencias más significativas que están cuestionando el régimen jurídico de los empleados públicos con relación temporal, tanto laboral como administrativa. Para ello se lleva a cabo un comentario de la Directiva 1999/70/CE del Consejo, de 28 de junio de 1999, relativa al Acuerdo Marco de la CES, la UNICE y el CEEP sobre trabajo de duración determinada. Esta Directiva, con muchos años de vigencia, es el texto normativo que se viene empleando por el TJUE y por los órganos jurisdiccionales europeos para resolver las situaciones de abuso en la contratación temporal, así como las regulaciones discriminatorias para el trabajo de duración determinada. Puede decirse que hay, desde hace tiempo, una doctrina estable del TJUE sobre los problemas derivados del trabajo temporal en el empleo público. Pero es ahora, en una situación de crisis, reducción del gasto y de las ofertas de empleo público, cuando los problemas del empleo público temporal se vienen manifestando con más intensidad. Esta obra clarifica el estado de la cuestión con una atención a las sentencias del TJUE sobre la citada Directiva y Acuerdo Marco.
