Book excerpt: Negative sentiment regarding conducted energy weapons is due largely to a lack of understanding about the technology behind such weapons and a misunderstanding of those weaponsOCO physiological effects. Media accounts that speculatively associate sudden in-custody deaths with the use of conducted energy weapons only add to the confusion. TASER ELECTRONIC CONTROL DEVICES AND SUDDEN IN-CUSTODY DEATH documents 310 deaths in the United States proximate to the application of TASER electronic control devices from 1983 through 2006. The study examines the phenomenon of sudden death as it relates to electromuscular disruption technology and TASER electronic control devices by constructing 213 cases studies, dating from 1983 through 2005, and analyzing information available from news accounts, police reports, and autopsies. After reviewing the available evidence from this extensive case study, the author concludes that these conducted energy weapons are excluded as the cause of death in 182 of the 212 cases. In only two cases did the evidence tend to confirm the weapon was either a cause of death or a significant contributing factor. While arguing that the TASER electronic control devices are safe less-lethal weapons, the author also cautions that they are not completely effective. He notes that the weapons were not effective in subduing more than 60 percent of violent or aggressive subjects in the 213 case studies, and he documents 131 cases of fatal police shootings and one police fatality following the failure of the weapons. The only way to determine whether the TASER electronic control devices is responsible for deaths is to separate evidence from conjecture and analyze the facts of each case. This book will be an excellent resource for law enforcement professionals, attorneys, investigators, and criminal justice personnel."

A National Institute of Justice (NIJ)-sponsored expert panel, convened to evaluate the safety and effectiveness of CEDs and concluded that law enforcement officers need not refrain from using CEDs to place uncooperative and combative subjects in custody provided that the CEDs are used in accordance with accepted national guidelines and an appropriate use-of-force policy. The panel also concluded that field use of CEDs is safe in the vast majority of cases and creates less risk of injury to officers and suspects alike, than other options of subduing uncooperative persons. Excerpt: Critics argue that Tasers and other high-voltage stun devices can cause cardiac arrhythmia in susceptible subjects, possibly leading to heart attack or death in minutes by ventricular fibrillation, which leads to cardiac arrest and-if not treated immediately-to sudden death. People susceptible to this outcome are sometimes healthy and unaware of their susceptibility. Although the medical conditions or use of illegal drugs among some of the casualties may have been the proximate cause of death, the electric shock of the Taser can significantly heighten such risk for subjects in an at-risk category. Tasers, like other electric devices, have been found to ignite flammable materials. For this reason Tasers come with express instructions not to use them where flammable liquids or fumes may be present, such as filling stations and methamphetamine labs. An evaluative study carried out by the British Home Office investigated the potential for Tasers to ignite CS gas. Seven trials were conducted, in which CS gas canisters containing methyl isobutyl ketone (a solvent in all CS sprays used by the United Kingdom police) were sprayed over mannequins wearing street clothing. The Tasers were then fired at the mannequins. In two of the seven trials, "the flames produced were severe and engulfed the top half of the mannequin, including the head." This poses a particular problem for law enforcement, as some police departments approve the use of CS before the use of a Taser. This involved three main data sources: WAPOL data about Use of Force reports from 2007 to 2009; the Commission's assessment and review3 work, pursuant to section 18 of the Corruption and Crime Commission Act 2003 (“the CCC Act”); and detailed analysis of Use of Force reports for the periods December 2007, July 2008 and between July and September 2009. -- The majority of Taser weapon use by WAPOL is reasonable and the Taser weapon is an effective tool to assist police perform their duties. However: firearm use has increased since the introduction of Taser weapons, and injuries to police officers have remained the same; Taser weapons are being used for compliance, including against indigenous people and those suffering mental illness, contrary to the intention of the WAPOL policy; Taser weapons are causing injury. There is a risk that Taser weapon use will lead to a death; and there is evidence in Western Australia that Taser weapons are being used in situations for which they were not intended to be used and where such use is potentially excessive or improper. This appears to be an increasing trend. The threshold for Taser weapon use and related policy environment needs to be changed to avert this trend.
