Book Protecting Your Family s Assets in Florida

Download or read book Protecting Your Family s Assets in Florida written by John R. Frazier and published by Rainbow Books. This book was released on 2008-09 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Florida, private-pay costs at nursing facilities can exceed $6,000 per month. Many families cannot afford to pay such excessive amounts - which can total more than $70,000 per year! The Florida Medicaid program can offer a solution to the high cost of nursing home and assisted living care. But Medicaid has such strict asset-and-income limitations that most people believe it can be used by only the very poor. Fortunately, the U.S. Congress and Florida law provide opportunities to help your family receive financial assistance through Medicaid and protect hard-earned assets. With proper planning, even those whose assets and income greatly exceed the limits for Medicaid can qualify for benefits. Florida Eldercare Attorney John R. Frazier describes multiple strategies that families can use to qualify for Medicaid assistance. Protecting Your Family's Assets in Florida includes details covering the following topics, specific to both Florida and Eldercare: The Department of Children and Families, The Agency for Health Care Administration, The Department of Elder Affairs, The Institutional Care Program, The Medicaid Waiver Program, The Long Term Care Diversion Medicaid Program, Florida Durable Power of Attorney and Guardianship, The Deficit Reduction Act of 2005 in Florida, Veterans Benefits and Medicare. Whether planning for your family's future or in immediate, desperate need of lawful answers for you, your spouse or a loved one, Protecting Your Family's Assets in Florida can help. Written in easy-to-read language, it provides examples for the most common Medicaid scenarios faced by families in Florida. Book A Penny Saved Can Be a Penalty Earned

Download or read book A Penny Saved Can Be a Penalty Earned written by Catherine M. Reif and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Deficit Reduction Act of 2005 (DRA) makes it difficult for a senior citizen to transfer financial assets and subsequently qualify for Medicaid's long-term care benefit. It makes it so difficult, in fact, that it creates a class of sick, poor senior citizens who do not qualify for Medicaid because they inadvertently transferred assets long before they had reason to believe that they would need long-term care. Essentially, Medicaid law expects senior citizens who gave away money during the past five years to recover it and spend it on nursing home care before they qualify for Medicaid. However, senior citizens who simply spend their money - on cars, home improvements, or whatever they choose - are not expected to recover it and incur no penalty. The hardship waivers that are supposed to provide a safety net for ill senior citizens who are denied Medicaid coverage are useless because they are applied so restrictively. The result is the exclusion from Medicaid of the people it was designed to serve. This article discusses how financial asset transfers are treated under Medicaid law, both before and after the DRA's enactment, and analyzes whether Medicaid policy is served by the DRA's changes. The article also proposes solutions to the problems caused by the DRA and presents a strategy for seniors to transfer some financial assets and still qualify for Medicaid. Finally, the article advocates for changes to Medicaid law, including changing the hardship waiver procedures, increasing the asset exemption amount, and rolling back the DRA. These changes would enable Medicaid law to perform the function for which it was designed - to provide a safety net for our nation's poorest and sickest citizens.

Available in PDF, EPUB and Kindle. Book excerpt: Elder Law in Context integrates cases, statutory materials, forms, policy and ethics to provide a well-rounded and comprehensive study of Elder Law. The book demonstrates that the law of any given practice area in reality isn't made up of discrete doctrinal areas but rather consists of interrelated and overlapping areas, and covers legal doctrine in contracts, agency, ethics, torts, constitutional law, administrative law, public law, criminal law and more, as they relate to Elder Law. This approach provides both an excellent and practical vehicle for learning Elder Law, but, by reviewing core doctrine from earlier and more foundational law school courses, it helps to prepare upper level students for the bar exam. The book provides ample opportunities for students to apply lessons, through the various problems and exercises throughout.
