No en vano, el principio de la «autonomía de la voluntad» o de la «autonomía privada» consagra el poder de los sujetos para satisfacer sus necesidades en los distintos ámbitos de su vida cotidiana mediante la elección, modificación y creación de las normas que estimen más convenientes para ello. Sentado lo anterior, el propósito de este estudio es presentar de forma breve y sencilla los aspectos e implicaciones más importantes de dicho principio, con especial atención a su repercusión en el ámbito de la contratación privada. Para ello, mientras que en la primera parte de la obra se estudiará su génesis histórica y posterior desarrollo filosófico-legislativo hasta llegar a convertirse en una de las piedras angulares del Código Civil, en la segunda se tratará de poner de manifiesto su extenso contenido, identificar sus numerosas manifestaciones prácticas y señalar los límites y restricciones de diversa naturaleza que lo afectan en el siglo XXI.
