Muy al contrario, simplemente ofrece un punto de vista personal, sobre los principales problemas que tiene planteados en la actualidad la Filosofía del Derecho. A través de sus páginas, se ofrece un relato, sobre el ser de la Filosofía del Derecho, la esencia del Derecho, y el pensamiento filosófico jurídico de los siglos XIX, XX y XXI visto con los ojos de algunos de sus principales protagonistas. También muestra un panorama de las relaciones entre el Derecho y la lógica, especialmente referidas a la interpretación, a la argumentación, y a la metodología jurídicas. Tampoco olvida la importancia del estudio de la relación del Derecho con los valores, especialmente con la justicia, que es el primero y más importante de todos ellos. Por último, reflexiona sobre la deontología profesional, estudiando de forma más concreta, las particularidades deontológicas de los principales operadores jurídicos. Los temas elegidos forman parte de algunos de los más debatidos dentro de la Filosofía del Derecho actual. Reflexionar sobre estos problemas es una labor propia de todo jurista, en realidad lo es, de todo ser humano preocupado por entender y mejorar si es posible, el mundo que le rodea. Este libro modestamente pretende ayudar en ese intento. Milagros Otero Parga, nació en Santiago de Compostela en 1960. Es doctora en Derecho (1987) por la misma Universidad. En la actualidad y desde 2011, es Catedrática de Filosofía del Derecho. Ha publicado 16 libros y 138 artículos en revistas nacionales e internacionales. Los temas a los que presta mayor atención son Axiología Jurídica, Derechos Humanos, Historia del pensamiento Jurídico, Argumentación Jurídica y Mediación. Es profesora invitada en algunas de las más prestigiosas universidades de Bue­nos Aires, Santiago de Chile, Sao Paulo y Montevideo. Asidua visitante de México ha sido conferenciante en las universidades Iberoamericana, Panamericana, Ana­huac, Intercontinental, Autónoma del Estado de México, Instituto Tecnológico de Monterrey, Universidad Judicial de Durango y Universidad Popular Autónoma del Estado de Puebla. Es asesora académica de la Comisión de Derechos Humanos del Estado de México y de la Escuela Judicial del mismo Estado. Este último orga­nismo la nombró también Magister Honoris Causa. Es académica numeraria de la Real Academia Gallega de Jurisprudencia y Legislación. Fue decana de la Facultad de Derecho de la Universidad de Santiago de Com­postela y secretaria de la Comisión de Doctorado y Tercer Ciclo de la Universidad. Tiene en su poder la Medalla de Plata de Galicia, la Insignia de Oro de la Facultad de Derecho, y la Insignia de Oro de la Universidad de Santiago. Ha sido Valedora do Pobo de Galicia (2015-2019).

Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

El estado bolivariano es auténtico se fundamenta en la historia, las ideas solidarias de Simón Bolívar y la prioridad de los derechos humanos básicos de "seguridad y subsistencia" de todos los venezolanos sin exclusiones. Es revolucionario primero porque incorpora participativamente a un sector mayoritario de la población -incluyendo a los pobres y a los militares-- que habían sido históricamente marginados y excluidos de la política, la economía y la sociedad. Segundo, porque el nuevo modelo de "Seguridad y Subsistencia" es lo opuesto a su predecesor histórico: el modelo de "Seguridad Nacional" o "Pacto de Punto Fijo." La "Seguridad Nacional" fue impuesta desde los Estados Unidos durante la guerra fría a toda su área de influencia y ha causado estragos: guerras, muertes, torturas y la violación sistemática de los derechos humanos en Venezuela, en Latinoamérica y en muchas partes del mundo. Tercero, porque el modelo bolivariano ofrece una respuesta democrática y solidaria al capitalismo salvaje que propone el neo-liberalismo en la actualidad. Venezuela hoy nos ofrece algo radicalmente diferente, es "la posibilidad optimista" de una democracia nueva, solidaria, soberana, socialista, moderna, no dogmática y por qué no, ecológica.

Sin embargo, a pesar de la diversidad de los trabajos que conforman este volumen, puede decirse que son dos los aspectos fundamentales que éstos comparten: por un lado, la necesidad de fomentar el diálogo entre disciplinas diferentes como la Filosofía y el Derecho en torno a una cuestión central, a saber, la existencia de elementos pre-positivos, anteriores a toda legislación positiva y, por otro lado, la convicción de que estos elementos tienen una inteligibilidad propia. *** Der Ursprung des vorliegenden Bandes ist ein im Mai 2015 vom Instituto Cultura y Sociedad der Universität von Navarra veranstaltetes Symposium. Wie die verschiedenen Beiträge zeigen, war die Bandbreite des Symposiums sehr weit gefasst. So wurden Themen behandelt wie die Zusammenhänge zwischen der phänomenologischen materialen Wertethik und der Idee des Naturrechts, die Unterscheidung zwischen der sittlichen und der rechtlichen Sphäre, die Kritik an denjenigen Theorien, die die Menschenrechte im Naturrecht verorten, die Motive, die uns dazu veranlassen, gewisse Tatsachen und Pflichten als Folgen sozialer Akte zu betrachten, der Sinn des Wortes „Freiheit“ im Rahmen des Strafrechts oder die kritische Prüfung derjenigen Auffassungen, die die Rechtsphilosophie auf eine Reihe von psychologischer, sozialer bzw. historischer Fragen zu reduzieren versuchen, wenn sie in Wahrheit auf einer Diskussion über Grundsatzfragen und nicht auf reiner Tatsachenüberprüfung beruht. Trotz ihrer Vielfalt haben alle Beiträge zwei Aspekte gemeinsam: einerseits teilen sie die Überzeugung der Notwendigkeit eines Dialogs zwischen so verschiedenen Disziplinen wie der Philosophie und dem Recht, um die zentrale Frage nach dem Bestehen von vor-positiven Elementen des Rechts aufzuklären, die jeder positiven Gesetzgebung vorangehen; andererseits sind sie der Überzeugung, dass solche Elemente ihre eigene Verständlichkeit haben. This volume contains the proceedings of a conference organized in May 2015 by the Instituto Cultura y Sociedad (University of Navarra). The scope of this conference was very wide as is proved by the variety of the contributions. They deal with such topics as the relationships between material value ethics and the idea of natural law, the distinction between the moral sphere and the sphere of law, the criticisms of those theories which ground human rights in natural law, the motives which lead us to consider certain facts and duties as consequences of social acts, the meaning of “freedom” in criminal law or the critical exam of such views which try to reduce the Philosophy of Law to some psychological, social or historical questions. However, despite their diversity, the contributions share two elements: on the one hand, the emphasis of the necessity of a dialogue between such different disciplines as Philosophy and Law focusing on a central question, namely, the existence of pre-positive elements, prior to every positive legislation and, on the other hand, the conviction that such elements have an own intelligibility.
