Partiendo de aquí, el ordenamiento procesal ofrece con carácter muy excepcional remedios para poner fi n a la eficacia de la sentencia firme cuando esta se ha obtenido de manera injusta. A esta categoría pertenece el incidente de nulidad de actuaciones. La reciente historia de nuestro incidente ha discurrido por un sinfín de avatares dentro de nuestro sistema procesal. Ha pasado de ser un incidente procesal imprescindible en la práctica forense a desaparecer de nuestro ordenamiento; de restaurarse como un incidente excepcional a convertirse en paso casi obligado para quien aspira a que su reclamación llegue a ser atendida por el Tribunal Constitucional. En la primera parte del presente trabajo el autor ha llevado a cabo un estudio teórico que finalmente ha venido a ser particularmente práctico. Desvelar la singular naturaleza jurídica de una institución que se insinúa como incidente, como recurso y como acción impugnativa, o valorar el doble fundamento que presenta (procesal y constitucional) ha sentado las bases para analizar la enorme virtualidad práctica de esta institución. En una segunda parte del trabajo el autor examina el régimen procesal del incidente de nulidad de actuaciones con el objetivo de que sea de utilidad para los profesionales del Derecho. El análisis sistemático de los presupuestos y de la tramitación del incidente da respuesta a las preguntas sobre la formulación, admisión a trámite y resolución del mismo. De esta manera el autor pretende facilitar la utilización de este singular mecanismo procesal, que puede llegar a ser tanto un último remedio frente a la pretensión rechazada como una amenaza de perder la estabilidad que confiere la cosa juzgada. Pedro Álvarez Sánchez de Movellán es Profesor Titular de Derecho Procesal de la Universidad de León. Es autor de diversas monografías de su especialidad y ha participado en varias publicaciones colectivas de enorme relevancia; destacan La anulación del laudo arbitral, La prueba por presunciones y La imposición de costas en la primera instancia civil. Además ha publicado numerosos artículos en revistas de prestigio, tanto nacionales como internacionales. Fue Premio Extraordinario de Doctorado. Ha dirigido como investigador varios proyectos relacionados con su disciplina y además ha tenido ocasión de coordinar varios proyectos de innovación docente, algunos de ellos en colaboración con el Centro de Estudios Jurídicos del Ministerio de Justicia; durante un tiempo estuvo compatibilizando su actividad académica con el ejercicio de funciones judiciales como magistrado y, por lo tanto, tiene un amplio conocimiento de las cuestiones procesales a nivel teórico y práctico.
