La consecuente reasignación de roles familiares que se deriva de la reconstitución familiar, implica cada vez más frecuentemente la asunción de responsabilidades parentales por parte de las nuevas parejas de los progenitores. Asistimos a una disociación entre la paternidad biológica y social; en la constitución de la familia, el elemento carnal, biológico va perdiendo importancia en provecho del elemento psicológico, afectivo. Se hace por ello preciso calibrar el posible reconocimiento de derechos a un padre «no legal», así como examinar aquellos mecanismos a través de los cuales es factible otorgarles legitimidad. Es destacable, sin embargo, tras una descripción y valoración de la situación actual, la desidia del legislador español en lo que se refiere a las particulares circunstancias generadas por este tipo de familias. Esta realidad no viene acompañada de un reconocimiento legal, salvo, en ciertas ocasiones, a través de algunas disposiciones dispersas del Código Civil, en todo caso, fragmentarias. Todo ello trae como consecuencia la utilización incorrecta de otros instrumentos que pone de manifiesto los problemas suscitados por la aplicación de una legislación que no tiene en cuenta ni sus características ni su dinámica. De ahí la necesaria intervención legislativa, a semejanza de lo que han venido haciendo los países de nuestro entorno jurídico, con el fin de dar cobertura jurídica al papel de los padrastros mediante la enunciación precisa de derechos y obligaciones que de respuesta a las exigencias de protección del menor. La autora, profesora de Derecho Civil en la Universidad de Cantabria, ha centrado sus principales líneas de investigación en el Derecho de Obligaciones y Contratos. Entre sus obras destacan «El contrato de transacción», ed. Thomson-Civitas, 2003 (Premio Sancho Rebullida a la mejor tesis de Derecho Civil de España, 2002; Premio Consejo Social UC, 2002) y «La protección patrimonial del crédito», ed. Thomson-Civitas, 2006. Además, se ha detenido en el análisis del Derecho de familia y en este sentido son diversos los artículos que recientemente ha dedicado a las últimas reformas sobre la materia; entre otros: «El interés del menor como criterio de atribución de la custodia» (RDF; Mención de Honor en los Premios Balbuena de la Rosa-CEU, 2007); «La custodia compartida como alternativa legal» (RCDI, 2007); «Las uniones de hecho y las relaciones paterno-filiales en el derecho europeo» (RDF, 2008); «La mediación familiar desde una perspectiva comparada» (2008, 25 Aniversario de la Facultad de Derecho de la UC);... Dichas investigaciones vienen avaladas por distintas estancias en el extranjero (Bolonia, Laussanne, Lieja,...) y en concreto la que aquí se presenta ha sido el resultado de la concesión de una beca por la UC para la realización de estudios europeos en la Universidad París II.
