Book excerpt: El Real Decreto Ley 16/2022, de 6 de septiembre, ha acometido una profunda remodelación del marco extintivo del empleo doméstico, integrando medidas de calado, con el objetivo de mantener tan solo aquellos elementos diferenciadores que, por las singularidades de esta relación especial, no encajen plenamente en el esquema común de las causas de extinción del contrato de trabajo. La más relevante, sin duda, la eliminación de la figura del desistimiento, decisión dirigida a corregir disfunciones de la regulación, hasta entonces vigente, como la notoria "vis atractiva" de dicha figura, que ha venido siendo utilizada como el mecanismo habitual de extinción (salvo concurrencia de un motivo de despido disciplinario irrebatible y plenamente acreditable). Desde el prisma constitucional, era igualmente evidente el efecto lesivo sobre los derechos fundamentales de un mecanismo que no exigía causa alguna para operar (repárese en el efecto abusivo que el desistimiento ha tenido sobre los derechos fundamentales de las empleadas del hogar embarazadas). Ahora, eliminada tal posibilidad de extinción libre, y concretadas las causas que, al margen del art. 49 ET, pueden dar lugar a la terminación contractual (las contempladas en el nuevo art. 11.2. RD 1620/2021), la posición de la persona empleada del hogar frente a un cese injustificado queda notablemente reforzada. La presente obra expone detalladamente ese "nuevo esquema" y pretende resolver las dudas interpretativas en la aplicación de la nueva norma, abordando, entre otras cuestiones, el complejo deslinde entre el cese indemnizado del citado art. 11.2 y el que deriva de la extinción disciplinaria del art. 54 ET. En todo momento se ha procurado combinar el rigor dogmático con la visión práctica de los diversos problemas abordados. Book excerpt: How American colonists laid the foundations of American capitalism with an economy built on credit Even before the United States became a country, laws prioritizing access to credit set colonial America apart from the rest of the world. Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Credit Nation presents a new vision of American economic history, one where credit markets and liquidity were prioritized from the outset, where property rights and slaves became commodities for creditors' claims, and where legal institutions played a critical role in the Stamp Act crisis and other political episodes of the founding period.

At its centre is a rejection of the death penalty as excessive, unnecessary, and pointless. Beccaria is deservedly regarded as the founding father of modern criminal-law reform, yet he was not the first to argue for the abolition of the death penalty. Against the Death Penalty presents the first English translation of the Florentine aristocrat Giuseppe Pelli's critique of capital punishment, written three years before Beccaria's treatise, but lost for more than two centuries in the Pelli family archives. Peter Garnsey examines the contrasting arguments of the two abolitionists, who drew from different intellectual traditions. Pelli was a devout Catholic influenced by the writings of natural jurists such as Hugo Grotius, whereas Beccaria was inspired by the French Enlightenment philosophers. While Beccaria attacked the criminal justice system as a whole, Pelli focused on the death penalty, composing a critique of considerable depth and sophistication.
