Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

In the USA the former Attorney General Janet Reno identified the issue as 'one of the most pressing problems we face as a nation' in view of the massive prison population and the rapid increase in rates of incarceration, while in the UK it has become an increasingly important issue for similar reasons, and the subject of recent reports by HM Inspectorate of Prisons and HM Inspectorate of Probation, as well as from the Social Exclusion Unit of the Home Office. Yet this issue has not been well served by the criminological literature, and the new policies and programmes that have been set up to address the problem have not been well grounded in criminological thinking. This book seeks to address the important set of issues involved by bringing together the best of recent thinking and research into desistance from crime, drawing upon research in both the UK and the USA, and with a distinct focus on how this might impact upon the design and implementation of ex-offender reintegration policy.

Yet the duel was also an act of potentially deadly violence and a challenge to the authority of statutory law. When duelling became widespread in early twentieth-century Uruguay, legislators facing this dilemma chose the unique and radical path of legalization. The Pen, the Sword, and the Law explores how the only country in the world to decriminalize duelling managed the tension between these informal but widely accepted “gentlemanly laws” and its own criminal code. The duel, which remained legal until 1992, was meant to ensure civility in politics and decorum in the press, but it often failed to achieve either. Drawing on rich and detailed newspaper reports of duels and challenges, parliamentary debates, legal records, private papers, and interviews, David Parker examines the role of pistols and sabres in shaping the everyday workings of a raucous public sphere. Demonstrating that the duel was no simple throwback to archaic conceptions of masculine honour and chivalry, The Pen, the Sword, and the Law illustrates how duelling went hand in hand with democracy and freedom of the press in one of South America’s most progressive nations.
