Sus catorce capítulos conforman un Curso general de Derecho Internacional Público que trata de las características de la sociedad internacional actual y el estatuto de sus sujetos; de la elaboración, efectos y crisis de las normas internacionales, y del modo como este Ordenamiento jurídico, sentando dos obligaciones complementarias, ha respondido ante los muchos conflictos que en las relaciones internacionales se originan, a saber, que las controversias internacionales deben resolverse de manera pacífica y que, por ello mismo, el uso de la fuerza armada es ilegal. En fin, quien lea estas páginas podrá saber en qué supuestos esta rama del Derecho considera que se comete un hecho ilícito y cuáles son, para el culpable, la víctima y, en su caso, la comunidad internacional en su conjunto, las consecuencias de esa violación. El Derecho Internacional ha progresado mucho en los últimos años: lo ha hecho al ampliar y afinar su sistema normativo, al incluir cada vez con más frecuencia en los tratados y otros instrumentos internacionales cláusulas compromisorias que conducen a que un tercero imparcial, en muchos casos mediante una decisión jurídicamente vinculante, decida los conflictos. Con todo, es verdad que esta rama del Derecho ha encallado en algunos ámbitos que lastran su mejora y perfeccionamiento, como el riesgo que representa su posible fragmentación jurídica o la aparición de una inquietante tendencia a erosionar la prohibición del uso de la fuerza armada... El Derecho Internacional se enfrenta a una encrucijada: o se hace de él «un seguro para la supervivencia de la Humanidad» (Tomuschat) o este Ordenamiento será marginado como factor de regulación de las relaciones internacionales.

Book excerpt: Parties negotiating the end of authoritarian regimes or armed conflicts are almost inevitably left in a situation of legal uncertainty. Despite their overlapping scope of application, the differences between the approaches of International Criminal Law (ICL) and Transitional Justice (TJ) are so profound that, unless dogmatisms are left aside and a process of dialogue is entered into, it will not be possible to harmonize the current legal regime of international crimes with the need to articulate transitional processes that are capable of effectively overcoming authoritarian regimes and armed conflicts. The serious material limitations shown by national, international and hybrid ICL enforcement mechanisms should be acknowledged and the goals pursued by ICL should be redefined accordingly. A minimum level of consensus on the scope of application, goals and elements of TJ should also be reached. Situations of systematic or large scale violence against the civilian population by transnational criminal organizations increase the challenge.
