Este hecho ha motivado un activismo por parte de la Comisión en el análisis, detección y represión de determinadas conductas restrictivas de la competencia que pueden estar en la base del escaso desarrollo del comercio electrónico transfronterizo. El geobloqueo, entendido como el rechazo a llevar a cabo transacciones económicas online por razón de la residencia o nacionalidad de quien las realiza, es una de las prácticas sobre las que más se ha puesto el foco de atención recientemente. El geobloqueo, que puede afectar tanto a la comercialización de bienes como de servicios, adquiere una especial significación cuando afecta a los servicios prestados de forma digital y ligados, con carácter general, a contenidos fuertemente protegidos por derechos de autor y, por ello, a este aspecto se dedica un apartado especial de la obra. No pasarán desapercibidas las consecuencias de esta problemática sobre la compartimentación del mercado, por su clara configuración como obstáculo a la libre circulación. Sin embargo, por su carácter poliédrico, el geobloqueo proyecta sus efectos, asimismo, sobre el Derecho de defensa de la competencia cuando es impuesto, por ejemplo, en el seno de sistemas de distribución, o como posible práctica desleal por discriminatoria, cuando se ofrecen a adquirentes de diferentes Estados los mismos bienes o servicios en condiciones distintas.

While some businesses are relaying on their corporate website to make the sale, both traditional brick-and-mortar and new disruptive business models are increasingly using online marketplaces to offer their products online. European Union law has been gradually updated to reflect this new reality, with Intellectual Property Rights legislation and Consumer Law leading the way toward a suitable regulatory framework in the Platform Economy. However, the EU has not devised a comprehensive strategy for tackling the challenges posed by the online sale of physical consumer goods, such as effective public enforcement in online environments. In fact, sector-specific legislation, including Food Law, largely ignores online transactions. In this context, the book evaluates the impact that online marketplaces are having on European Union sector-specific legislation and its e-nforcement. The goal is to assess whether the existing regulatory and policy framework are sufficient for promoting compliance and bridging the enforcement gap in the digital single market.
