Book excerpt: Los modernos Estados democráticos forjados alrededor de la idea nuclear de Constitución escrita como instrumento para la limitación del Poder han configurado con el tiempo los principios de control y responsabilidad como elementos consustanciales a la idea misma de democracia. De esta manera se ha dado cumplimiento a una de las pretensiones centrales de la teorización de Montesquieu, por cuanto, la separación de poderes no es, en el fondo, otra cosa que, la articulación feliz de la idea de que “el Poder límite al Poder”. Así, si del Estado absoluto se podía predicar una suerte de irresponsabilidad con fundamento en sus atributos de soberanía, lo propio y sustancial del Estado democrático es el hecho de constituirse y nacer al ordenamiento jurídico como un Estado limitado y, por ende, dotado de unos Poderes públicos responsables y sometidos a control en sus decisiones por los representantes de la voluntad popular. Con el transcurso del tiempo, estas nociones de responsabilidad y dación de cuentas han ido construyendo una teoría del control de los órganos constitucionales y de la actividad de la propia Administración pública, que ha dado en buena medida fundamento a la propia construcción del Estado de Derecho. Las formas y modalidades en que ese control se han ido constitucionalizando o legalizando son variadas y diversas, en buena medida, dependientes de la propia evolución del Estado absoluto al constitucional y, posteriormente, profundizadas en las transformaciones habidas hasta desembocar en el Estado democrático y social vigente en nuestras actuales constituciones de los países integrantes de la Unión Europea. Así las cosas, podemos afirmar sin miedo a errar que control y responsabilidad son hoy conceptos que mutuamente se presuponen. Se trata, de verificar la adecuación de determinadas conductas al mandato político y al ordenamiento jurídico, según los casos, en cuya inadecuación va expresa o implícita una sanción o reprobación de la conducta practicada. En la medida en que, el Estado se ha democratizado, el control se ha sofisticado. Y así, una de las especializaciones de este control ha dado lugar al surgimiento del control político parlamentario sobre el Presupuesto y al control económico financiero del sector público estatal. Se trataría, en suma, de controlar la formación del Presupuesto como acto de consentimiento que incide sobre el patrimonio de los particulares y, en su histórico y protegido sacrosanto derecho de propiedad. Pero, se trata también de verificar que los actos del Ejecutivo de contenido económico, que son la inmensa mayoría de las decisiones políticas que el Gobierno adopta, se adecuen a las previsiones, cuantías y destino que el Parlamento representativo les haya querido otorgar. Si el Parlamento es la representación del pueblo y el Gobierno se contempla como el gestor y administrador de los caudales públicos, resulta lógico en el sistema que quién ha consentido la exacción de los tributos de los bolsillos de los particulares vigile el destino que a esos caudales se confiere. Y que este destino, además se desenvuelva en términos de eficacia y eficiencia para el erario público. Por cuanto, como se ha dicho, gobernar es gastar, en la medida en que ha ido extendiéndose la complejidad del Estado democrático y social, las Constituciones han ido en paralelo arbitrando mecanismos de control de la acción de gobierno, que a la postre han desembocado en, acaso, la que constituya la modalidad de control por antonomasia; es decir, aquella que consiste en autorizar, controlar y fiscalizar los fondos públicos de que dispone el Gobierno y las Administraciones a su servicio para impulsar la acción política y administrativa del Poder Ejecutivo. Y, ahí, se alza con indudable importancia el Presupuesto público aprobado por ley del Parlamento, como instrumento que da cuenta del gasto autorizado por la Cámara al que se vincula, inseparablemente, el control del destino de los créditos autorizados por el propio Parlamento.
