Por lo que en determinadas circunstancias debe poder reclamarse al causante que responda con su patrimonio en aquellas situaciones en las que no está justificado que se ampare en el seguro contratado. La entidad aseguradora se hace cargo de la indemnización de la víctima, pero debe quedar garantizado su derecho de repetición en los casos en los que le corresponde. La cobertura del seguro se extiende, no sólo a supuestos que debe en realidad asumir el causante, sino incluso a otros en los que la responsabilidad podría corresponder al Consorcio de Compensación.

Un sistema de garantías, destinado a asegurar a la víctima la efectiva satisfacción de la indemnización, constituido por el seguro obligatorio de responsabilidad civil de vehículos de motor (SOA) y por un Fondo de Garantía (el Consorcio de Compensación de Seguros [CCS]), que interviene en determinados supuestos. Un particular título de imputación de responsabilidad para los llamados "daños a las personas", sustentado en la idea de riesgo de carácter objetivo (los daños materiales siguen el sistema general de imputación subjetiva), pero modalizado por dos específicas causas de exoneración, la culpa de la víctima y la fuerza mayor ajena a la circulación del vehículo (art. 1o.1, párrafos 1o y 2o LRCSCVM). Un particular sistema de valoración de daños a las personas, contenido en el Anexo de la LRCSCVM. Por último, un específico sistema procesal, caracterizado por el llamado juicio ejecutivo del automóvil, que se sustenta en la emisión del auto ejecutivo, regulado por los arts. 9 a 16 LRCSCVM y por la Ley de Enjuiciamiento Civil. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
