This transformation is divided into four periods: an initial recession caused by the transformation; economic growth in the mid-1990s; a recession connected to the currency crisis of 1997; and recovery and growth from 1999 until 2004, when the analysis ends. The examination covers the main aspects of the transformation?an overall view of the process, political transition, economic policy, economic results (GDP development, infl ation, unemployment), changes in outside indicators (balance of payments), privatization, transformation of the fi nancial sector, and changes in the business sector and institutional development. The book also compares Czech development in this transformative era to those of Poland and Hungary. It revolves around the theory of “optimal planning” which promised a profound modernization of Stalinist-style verbal planning. Encouraged by cybernetic dreams in the 1950s and supporting the strategic goals of communist leaders in the Cold War, optimal planners offered the ruling elites a panacea for the recurrent crises of the planned economy. Simultaneously, their planning projects conveyed the pride of rational management and scientific superiority over the West. The authors trace the rise and fall of the research program in the communist era in eight countries of Eastern Europe, including the Soviet Union, and China, describing why the mission of optimization was doomed to fail and why the failure was nevertheless very slow. The theorists of optimal planning contributed to the rehabilitation of mathematical culture in economic research in the communist countries, and thus, to a neoclassical turn in economics all over the ex-communist world). However, because they have not rejected optimal planning as “computopia,” there is a large space left behind for future generations to experiment with Big Optimal Plans anew—based, at this time, on artificial intelligence and machine learning.

Book excerpt: This edited volume opening the new series Revisiting Communism: Collectivist Economic Thought in Historical Perspective focuses on the concepts of ownership, the cornerstone of political economy in Soviet-type societies. The authors’ main objective is to contribute to the still unwritten chapter on collectivism in the history books of modern economic thought. They trace the lengthy evolution of economic ideas of property reform under communism leading from the doctrine of blanket nationalization to projects of moderate privatization in eight countries of Eastern Europe and China. The comparative analysis sheds light upon the tireless attempts of reform-minded economists in communist countries to populate the no man’s land of “social property” with quasi-private economic actors such as bodies of workers’ self-management and managers of state-owned companies. For a long time, these were expected to crowd out the communist nomenklatura from its actual ownership position without challenging the primacy of collective property rights. The fact that even the most radical reformers came to the conclusion that such surrogate owners would not be able to break the power of the ruling elite only on the eve of the 1989 revolutions demonstrates the immense strength of collectivist ideas. The authors coin the term “trap of collectivism” to warn those demanding nationalization or other forms of non-private ownership today: it is rather easy, even with the best intentions, to walk into this trap but it may take long decades to break out from it.

Book excerpt: Consumer protection has become a phenomenon of the past years and the combination of consumer protection and arbitration is especially sensitive. Some countries experience tens of thousands of consumer arbitrations each year while others significantly limit or even entirely exclude arbitration in consumer disputes. Many countries have undergone certain reforms in consumer disputes, the main objective of which is the protection of consumers in arbitration. The controversial variable is the degree of protection to be afforded to the consumer, both under the applicable substantive law and in procedural terms. These are the main issues addressed in this book. Apart from the key topic, the author has extensively elaborated on certain fundamental categories such as public interest and public policy (all primarily in connection to the procedural mechanisms of consumer protection); he has also analyzed the applicable European law and the case law of the ECJ and offered an overview of the individual systems employed in both European and non-European countries (especially the USA and Canada). An integral part of this book is an extensive comparison and analysis of the voluminous case law (several tens of decisions), with reference to more than three hundred other available court decisions. The book also focuses on the position of the consumer in the individual procedural stages, the intervention of courts in arbitration motivated by consumer protection, the individual stages of proceedings, recognition and enforcement of arbitral awards rendered in consumer disputes, both in domestic context and in the international milieu etc. The international practice significantly influences the domestic environment in the individual countries. The key issue in the EU countries is, in principle, the enforcement of EU standards which influence the domestic models of consumer protection, primarily in connection with the autonomous EU interpretation of a number of institutions. Many related issues have not yet been addressed in the case law of certain states. In fact, some of them have never even been discovered. Besides, the enforcement of foreign arbitral awards requires, inter alia, the compliance with extra-EU international obligations binding on the individual states. And finally, arbitration is not regulated by the EU law, as opposed to consumer protection. Naturally, arbitration is to a significant extent regulated by international law. This results in conflicts between national, international interpretation and interpretation pursuant to the EU law, where the circumstances allow to apply the EU law. This book is intended for all readers who have any experience with enforcement of consumer rights, as well as for all professionals dealing with arbitration in general. It is therefore intended for general legal practitioners, lawyers, primarily arbitrators, of course, but also for judiciary dealing with civil matters in the broadest sense. Apart from a voluminous case law, the book quotes from a number of domestic and foreign sources and, above all, offers a long list of structured bibliography and detailed subject index, as well as a table of states, table of cases and list of legal sources. It is therefore not only an important tool for the practice, but also a useful instrument for academics (lawyers as well as other professionals).
