Book The International Law of Human Rights and States of Exception

Download or read book The International Law of Human Rights and States of Exception written by Anna-Lena Svensson-McCarthy and published by BRILL. This book was released on 2021-09-27 with total page 808 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study demonstrates the extensive protection that international law provides to human rights even in the most serious of emergencies when they are particularly vulnerable. Based on a meticulous analysis of preparatory works and practice under the International Covenant on Civil and Political Rights, as well as the American and European Conventions on Human Rights, and with a special chapter on the International Labour Organisation's approach to international labour standards and emergencies, this book shows that respect for the rule of law and the concept of a democratic society are controlling parameters in any valid limitation on the enjoyment of human rights. It further shows that respect for human rights and the operation of institutions such as the Legislature and Judiciary are crucial to enabling societies to address and eventually remedy the root causes of emergency situations. The study recommends possible directions for the development of case law and suggests some practical means to help ensure that international legal requirements are in fact respected in emergencies.

Book excerpt: An eye-opening portrait of global capitalism spanning 150 years, told through the history of the Tata corporation. Nearly a century old, the grand façade of Bombay House is hard to miss in the historic business district of Mumbai. This is the iconic global headquarters of the Tata Group, a multinational corporation that produces everything from salt to software. After getting their start in the cotton and opium trades, the Tatas, a Parsi family from Navsari, Gujarat, ascended to commanding heights in the Indian economy by the time of independence in 1947. Over the course of its 150-year history Tata spun textiles, forged steel, generated hydroelectric power, and took to the skies. It also faced challenges from restive workers fighting for their rights and political leaders who sought to curb its power. In this sweeping history, Mircea Raianu tracks the fortunes of a family-run business that was born during the high noon of the British Empire and went on to capture the world’s attention with the headline-making acquisition of luxury car manufacturer Jaguar Land Rover. The growth of Tata was a complex process shaped by world historical forces: the eclipse of imperial free trade, the intertwined rise of nationalism and the developmental state, and finally the return of globalization and market liberalization. Today Tata is the leading light of one of the world’s major economies, selling steel, chemicals, food, financial services, and nearly everything else, while operating philanthropic institutions that channel expert knowledge in fields such as engineering and medicine. Based on painstaking research in the company’s archive, Tata elucidates how a titan of industry was created and what lessons its story may hold for the future of global capitalism.

Book Interstate Conflicts and the International Civil Aviation Organization

Download or read book Interstate Conflicts and the International Civil Aviation Organization written by Michał M. Kobierecki and published by Taylor & Francis. This book was released on 2024-09-24 with total page 193 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book investigates the International Civil Aviation Organization (ICAO) and politicized debates held there. The author explores how participants have employed depoliticization as a defensive diplomatic technique in a multilateral forum. Analyzing cases such as the ICAO membership/ statehood of Spain, Taiwan, Cyprus, and South Africa; various instances of the Arab–Israeli conflict; shootdowns of the Korean aircraft by the USSR and Iranian aircraft by the United States; and the 21st century tensions between Russia and Western countries, the book focuses on how states under criticism defended themselves and used depoliticization rhetoric to weaken ICAO decisions. The book allows us to see how rivalries play out in a different environment to more investigated cases in the UN and INGOs such as the International Olympic Committee. This broad scope will appeal to scholars and students of international relations and political science, the Cold War, the Sino–Taiwanese conflict and the Arab–Israeli conflict. It will also appeal to practitioners working in civil aviation.

Book Party and Factional Division in Texas

Download or read book Party and Factional Division in Texas written by James R. Soukup and published by University of Texas Press. This book was released on 2014-09-10 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Here is the first attempt by scholars to make a comprehensive analysis of voting patterns in Texas. Examining the results of fourteen elections from 1946 through 1962 and organizing a vast fund of statistics relative to Texas political parties and voters, the authors have laid a solid groundwork for further studies in this field. The previously ineffectual Texas Republican Party made great strides in the twentieth century and became a competitor in state as well as national races. Specifically, the authors maintain that Texas in the 1960s was a “one and two-thirds party state.” Within the Democratic Party, factions analogous to warring camps immensely complicated the political struggle. Although the conservative elements within the Democratic Party still had a slight edge, growing liberal strength forced them to moderate their policies and tactics. The authors also contend that there were significant changes in the nature of the issues and the modes of political operation. Though some of the old motivations and tactics lingered on in less significant rural areas, friendship-oriented campaigns appealing to regional and family-like sentiments were being quickly replaced by an organized politics in which political activists made strong ideological appeals to economic and social interests. The Republicans, the conservative Democrats, and the liberal Democrats are each analyzed in relation to regionalism, demography, ethnic elements, and the economic system in Texas; and the history, present status, and future prospects of these factions are discussed in detail. Of special interest are the last two chapters, which analyze the 1962 elections and their bearings on evolving patterns of competition. The developments within the Republican Party and its challenge to the traditional Democratic Party are seen in the perspectives of the growing importance of minority groups and the impact of urbanization. All those interested in Texas politics and the history of the rise of the Republican Party in the state will find this study indispensable for an intelligent appraisal of historical developments.
