Updated as of May 29, 2018 This action sets forth the EPA's final decision on the issues for which it granted reconsideration in December 2011, which pertain to certain aspects of the March 21, 2011, final rule titled "Standards of Performance for New Stationary Sources and Emissions Guidelines for Existing Sources: Commercial and Industrial Solid Waste Incineration Units" (CISWI rule). This action also includes our final decision to deny the requests for reconsideration with respect to all issues raised in the petitions for reconsideration of the final commercial and industrial solid waste incineration rule for which we did not grant reconsideration. Among other things, this final action establishes effective dates for the standards and makes technical corrections to the final rule to clarify definitions, references, applicability and compliance issues. In addition, the EPA is issuing final amendments to the regulations that were codified by the Non-Hazardous Secondary Materials rule (NHSM rule). Originally promulgated on March 21, 2011, the non-hazardous secondary materials rule provides the standards and procedures for identifying whether non-hazardous secondary materials are solid waste under the Resource Conservation and Recovery Act when used as fuels or ingredients in combustion units. The purpose of these amendments is to clarify several provisions in order to implement the non-hazardous secondary materials rule as the agency originally intended. Book excerpt: "This report contains a summary of information on the hazardous waste incineration industry, a discussion and application of the risk analysis process for incinerators, and an evaluation of alternatives for controlling stack emissions from incinerators. It was prepared as part of the regulatory impact analysis program in support of the incinerator regulations under the Resource Conservation and Recovery Act (RCRA). Information on the incineration industry includes: a profile of facilities based on surveys of incinerator manufacturers and owner/operators, procedures for estimating capital and operating costs, data on the composition of hazardous waste streams currently incinerated, a technical and cost evaluation of 38 case study incinerators, and eight full-scale performance evaluations. Risk analysis is discussed as a tool that can be used in the regulatory process to assist those responsible for developing standards and managing risk to human health and environment. The rationale for EPA's proposal to allow variances to the incinerator standards based on a case-by-case consideration of risk is discussed and a structure for implementing the variance procedure is presented. An analysis of long and short term risk to human health from carcinogenic and toxic non-carcinogenic emissions based on case study and trial burn data and applicable health effects criteria is also presented. The evaluation of control alternatives includes: direct and indirect regulatory approaches, technology-based and performance-based standards, existing standards for principal organic hazardous constituents (POHCs), hydrogen chloride, and particulates, and possible regulation of products of incomplete combustion (PICs), metals, halogens, and hydrogen halides. Data contained in this report are used to estimate the costs of upgrading incinerators and the cancer risks from stack emissions for the whole domestic hazardous waste incineration industry."--Abstract.
