Book excerpt: Excerpt from Early Roman Law: The Regal Period In the matter of orthography I must apologize for certain inconsistencies. In all continuous Latin I have adopted the principle of making no symbolic distinction between the palatal vowel (i) and palatal spirant (some times written J), or between the labial vowel (u) and labial spirant (often written V). Such a distinction I believe to be not only destitute of good authority, but misleading. I should have preferred to employ the same symbol for the capital as for the small writing, both of labial and palatal: but V capital and u small seem too firmly established in good modern editions for me to dis turb them. Book Roman Law before the Twelve Tables

Download or read book Roman Law before the Twelve Tables written by Bell Sinclair W. Bell and published by Edinburgh University Press. This book was released on 2020-03-18 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Bringing together a team of international experts from different subject areas - including law, history, archaeology and anthropology - this book re-evaluates the traditional narratives surrounding the origins of Roman law before the enactment of the Twelve Tables. Much is now known about the archaic period, relevant evidence from later periods continues to emerge and new methodologies bring the promise of interpretive inroads. This book explores whether, in light of recent developments in these fields, the earliest history of Roman law should be reconsidered. Drawing on the critical axioms of contemporary sociological and anthropological theory, the contributors yield new insights and offer new perspectives on Rome's early legal history. In doing so, they seek to revise our understanding of Roman legal history as well as to enrich our appreciation of its culture as a whole.

Book The History of the Roman Or Civil Law

Download or read book The History of the Roman Or Civil Law written by Claude Joseph de Ferrière and published by The Lawbook Exchange, Ltd.. This book was released on 2005 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Through the influence of Doctors' Commons and the universities the civilians played an important role in the development of English law, especially in the fields of commercial, estate and admiralty law. Despite its value, study of the civil law had entered a moribund phase by the eighteenth century. Several student handbooks attempted to correct this deficiency, and Beaver's translation of Ferriere's treatise is among the best. Accompanied by Duck's learned essay that connects the civil law to the common law, the work is among the first in English to establish the confluence of these legal traditions. Also included is Beaver's translation of The History of the Origine of the French Laws, Translated from the French by J.B. Esq., Shewing, the Analogy of the Laws of the Antient Gauls and Britons. First published anonymously in 1703, it has been attributed to Ferriere, Gabriel Argou and Claude Fleury. Claude Joseph de Ferriere [ca. 1680-ca. 1750] was a well known French jurisconsult, dean of the Faculty of Law in Paris and the author of legal treatises and an important legal dictionary, Dictionnaire de Droit et de Pratique.
