Book excerpt: DUI Law Enforcement Strategies is an authoritative, insiders perspective on the procedures utilized by law enforcement officers for correctly identifying a potential DUI offense and making an arrest. Featuring law enforcement officials from across the country, these experts guide the reader through the key steps in the process of determining whether or not someone is driving while under the influence from the initial traffic stop to testifying in court. Discussing the role and responsibilities of the arresting officer in a DUI case, the authors explain how results from faceto- face observations, roadside field sobriety tests, and scientific blood-alcohol screenings are interpreted and what measures are taken to eliminate error. From the types of DUI training available to law enforcement officers and the most effective ways of documenting evidence to the preparation necessary to appear as a court witness, these officers break down the common misconceptions regarding law enforcement involvement with DUI violations and provide insight on how these cases are handled in court. DUI Law Enforcement Strategies is an eye-opening resource for prosecutors and defense attorneys alike on understanding how law enforcement actions and documentation can impact a case. The different niches represented and the breadth of perspectives presented enable readers to get inside some of the great law enforcement minds of today, as these experienced officers offer up their thoughts around the keys to navigating this increasingly-regulated legal issue.

Book The DUI Investigation Handbook

Download or read book The DUI Investigation Handbook written by David Jolly and published by Outskirts Press. This book was released on 2011-08 with total page 154 pages. Available in PDF, EPUB and Kindle. Book excerpt: The crime of Driving Under the Influence (DUI) begins and ends with the work of a well trained law enforcement officer. These officers observe driving behaviors of DUI drivers, respond to 911 calls and accidents, observe the physical appearances and mannerisms of DUI drivers, administer field sobriety tests to drivers, and ultimately must decide whether the driver is under the influence of alcohol or drugs. The complexity of these tasks under difficult conditions requires the law enforcement officer to make many decisions that will affect the individual being investigated and ultimately the case against this person. Therefore the decisions made by the officer must only be based on a thorough and well crafted investigation. This book details the DUI investigation process from the initial observations of driving, the first contact with the driver, and the administration of field sobriety tests. This book takes an objective view of the DUI investigation process and what law enforcement must do to properly and ethically proceed with each phase of the DUI investigation. This book is a must for every DUI law enforcement officer and any individual in the field of DUI, including prosecutors and defense attorneys.

Book Alcohol Drugs and Impaired Driving

Download or read book Alcohol Drugs and Impaired Driving written by A. Wayne Jones and published by CRC Press. This book was released on 2020-06-15 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: Alcohol, Drugs, and Impaired Driving addresses many theoretical and practical issues related to the role played by alcohol and other psychoactive drugs on driving performance, road-traffic safety, and public health. Several key forensic issues are involved in the enforcement of laws regulating driving under the influence of alcohol and/or other drugs, including analytical toxicology, pharmacology of drug action, as well as the relationships between dose taken, concentration levels in the body, and impairment of performance and behavior. Our knowledge of drunken driving is much more comprehensive than drugged driving, so a large part of this book is devoted to alcohol impairment, as well as impairment caused by use of drugs other than alcohol. For convenience, the book is divided into four main sections. The first section gives some historical background about measuring alcohol in blood and breath as evidence for the prosecution of traffic offenders. The important role of the Breathalyzer instrument in traffic-law enforcement, especially in Australia, Canada, and the USA is presented along with a biographical sketch of its inventor (Professor Robert F. Borkenstein of Indiana University) with focus on the man, his work and his impact. The second section discusses several issues related to forensic blood and breath-alcohol alcohol analysis as evidence for prosecution of traffic offenders. This includes how the results should be interpreted in relation to impairment and an evaluation of common defense challenges. Because most countries have adopted concentration per se laws, the main thrust of the prosecution case is the suspect’s measured blood- or breath-alcohol concentration. This legal framework necessitates that the analytical methods used are "fit for purpose" and are subjected to rigorous quality assurance procedures. The third section gives a broad overview of the current state of knowledge about driving under the influence of non-alcohol drugs in various countries. This includes adoption of zero-tolerance laws, concentration per se statutes, and clinical evidence of driver impairment based on field sobriety tests and drug recognition expert evidence. The fourth section deals with epidemiology, enforcement, and countermeasures aimed at reducing the threat of drunken and drugged driving. All articles have appeared previously in the international journal Forensic Science Review, but all are completely updated with current data, references, and the latest research on developments since the articles were published. This book contains a convenient collection of the best articles covering recommendations for blood and breath testing methods, public policy relating to such methods, and forensic and legal implications of the enforcement of measures to counter driving under the influence.

The central nervous system of the human being is explained in a manner that is easily understood by the average person, connecting the how and why the CNS is affected and therefore how this impairment manifests itself as a drunk driver as opposed to a drunk pedestrian. The manual also contains sections dealing with alcohol, depressant and stimulant drugs, which are critical to the proper understanding of the observable effects of drugs and alcohol. Also included are instructional objectives for each section, section quizzes and a comprehensive final exam. It will not only help to increase the confidence level of those everyday working street cops who must make decisions about whether to arrest or not arrest on any given impaired or intoxicated driver situation, but it will also provide the basis for the street cop to excel in this field of law enforcement and prepare themselves as an expert in the detection and arrest of DUI drivers.
