Ce contrat impose aux parties en présence des obligations nombreuses. La première partie de cette thèse donne une vue relativement exhaustive des incidences de l’exécution du contrat de transport de marchandises par mer sur la détermination de la loi applicable au contrat. En effet, le problème est rendu complexe par l'existence en France et au Maroc d'une pléthore de textes juridiques nationaux et internationaux susceptibles d’être applicables. La deuxième partie aborde les problèmes juridiques que posent l’exécution du contrat de transport maritime de marchandises par le transporteur hors et en lien avec le navire. S'agissant de l’exécution hors du navire, le transporteur se trouve lié à d'autres opérateurs pour exécuter certaines obligations. Quant à l’exécution par le navire, elle constitue la phase principale de l’exécution du contrat de transport maritime par le transporteur. En droit français comme en droit marocain, le transporteur a à sa charge une série d'obligations fondamentales qu'on peut repartir en trois phases : au début du voyage, il doit prendre en charge la marchandise, la mettre à bord, l'arrimer et l'assujettir. Pendant le voyage, il doit suivre la route normale, soigner la marchandise et le cas échéant la transborder. A la fin du voyage, les textes lui imposent de décharger et de livrer la marchandise. La troisième partie a été consacrée à l’étude du contenu de l’exécution du contrat par les ayants droit a la marchandise. En effet, en vertu de la réciprocité des obligations les textes et la jurisprudence n'ont pas manque de déterminer le contenu de l’exécution du contrat par les ayants droit aux marchandises. A savoir le chargeur doit présenter la marchandise et payer le fret et le destinataire doit retirer la marchandise.

Book excerpt: The carriage of goods by sea starts off with a contract of carriage, an essentially simple and straightforward contract between two parties, the shipper and the carrier. Very often, however, a bill of lading is issued and a third party appears on the scene: the holder of the bill of lading. The holder was not involved in the making of the contract of carriage, but does have rights, and possibly obligations, against the carrier at destination. The question then is how the third-party holder of the bill acquires those rights and obligations. Analysing the different theories that have been proposed to explain the position of the third party holder, this book makes a distinction between contractual theories and non-contractual theories to explain the holder's position. Contractual theories build on the initial contract of carriage and apply contract law mechanisms while non-contractual theories construe the position of the third-party holder independently. Following the analysis and appraisal of the different theories, this book makes the case that the position of the third-party holder of the bill of lading is not obvious or self-evident; and submits that a statutory approach to the position of the holder of the bill of lading has advantages and would be preferable.

Mais comme en droit international privé, le droit maritime international est, selon la législation qu'on lui applique, interprété différemment selon pays. Cette divergence d'interprétation ressort des disparités notables dans les décisions des différents pays, notamment en ce qui concerne les clauses insérées au connaissement. Par ailleurs, la conteneurisation qui représente des avantages en ce qui concerne la sécurité et la rapidité des chargements et déchargements, soulève des difficultés en ce qui concerne les fausses déclarations et le règlement des surestaries, faces auxquelles, force est de constater qu'un manque de moyens subsiste aux ports algériens et français. Autant de problématiques, qui touchent le plus souvent soit le transporteur maritime, soit le destinataire de la marchandise et qui ne sont pas entièrement traitées par les Conventions en vigueur actuellement. Ces textes qui avaient pour ambition l'uniformisation du régime international du contrat de transport maritime sous connaissement, ne permettent toujours pas d'atteindre l'harmonisation recherchée. La présente thèse a dès lors pour ambition d'en faire la critique dans une perspective constructive du régime juridique international du contrat de transport maritime de marchandises sous connaissement et du contentieux qu'il engendre en particulier en ce qui concerne les transports en provenance ou à destination de l'Algérie.

The advantages of electronic bills of lading are many, including lower cost, higher efficiency, improved security, and speedier delivery of goods at the end of the voyage (the collection of reports focus upon bills of lading for the international carriage of goods by sea). According to the contributors, the use of electronic bills of lading is, essentially, a business rather than a legal decision. The law may provide the legal framework for the function of electronic bills of lading in the same way and with the same effects as the traditional bills of lading. However, business interests will eventually determine whether the availability of, and the economic incentives for, the use of the electronic bills of lading outweigh concerns for privacy and the safeguarding of trade secrets, for accuracy of information, and for security transactions and acquisition. Such concerns call for technological rather than legal solutions. This book ahould appeal primarily to practitioners who are interested in economics and commerce.
