Updated as of May 29, 2018 The Coast Guard is amending its regulations to allow the discharge of bulk dry cargo residue (DCR) in limited areas of the Great Lakes by self-propelled vessels and by any barge that is part of an integrated tug and barge unit. DCR is the residue of non-toxic and non-hazardous bulk dry cargo like limestone, iron ore, and coal. These regulations also add new recordkeeping and reporting requirements and encourage carriers to adopt voluntary control measures for reducing discharges. Discharges are now prohibited in certain protected and sensitive areas where, previously, they were allowed. The Coast Guard also requests public comments on the need for and feasibility of additional conditions that might be imposed on discharges in the future, such as mandatory use of control measures, or further adjustments to the areas where discharges are allowed or prohibited. Book excerpt: ""Cargo sweeping" is the practice of removing the residues of dry bulk cargoes, such as iron ore, coal, grain, and various rock materials, from the deck and holds of cargo vessels. Such residues occur after most loading or unloading operations. Cleanup is accomplished by washing the decks and cargo spaces with water, which is then discharged over the side, usually while underway. Coast Guard regulations proposed in 1989 would have made the discharge of cargo residues illegal on the Great Lakes, which would have disrupted the continued operations of the U.S. Great Lakes shipping industry. In September 1994 a workshop was held to identify the research needed to provide a scientific basis for regulatory decisions. Three separate work groups, Risk to Fisheries & Habitat, Sediment Accumulation & Toxicity, and Water Column Impacts, were convened. Each group was asked to consider and identify what we already know and what gaps there are in our knowledge and understanding related to cargo sweeping, what further information or studies are needed, and how best to obtain the requisite information. [1.] All three groups identified the need for comprehensive information on the composition of the commodities, especially relative to impurities and added chemicals that might prove environmentally harmful. Such information should be obtained by literature searches and direct analyses of the composition. [2.] Each group indicated the need for studies to determine the bioavailability and bioaccumulation of cargo components and impurities that may be toxic. [3.] Each group identified a series of other information gaps and questions in need of answers, and recommended various approaches to obtain needed information."--Executive summary, Overview, p. 4.

Book excerpt: 07 October 2019 The Notice of Violation (NOV) program was implemented in 1995 to address the Coast Guard's concern that the civil penalty assessment process was too lengthy when applied to small oil discharges under 100 gallons and minor pollution prevention regulation violations (33 CFR parts 154, 155, and 156). The process time meant that a party frequently would have additional violations before being notified of an initial violation. Early resolution of these minor violations saved time and reduced costs of internal reviews, improved compliance and deterrence, and facilitated corrective action by providing more immediate notice to the charged party. Because of the success of the initial limited NOV program, it was expanded in 2004 to include oil spills of 1,000 gallons or less and to include violations of other laws and regulations that the Coast Guard enforces. Since its inception, the NOV program modified the civil penalty process by creating a regulation, 33 CFR 1.07- 11, that allowed for immediate notification to the responsible party of the alleged violation(s).

The oil type and properties, location, time of year, duration of spill, water depth, environmental conditions, affected biomes, potential human community impact, and available resources may vary significantly. Also, each spill may be governed by policy guidelines, such as those set forth in the National Response Plan, Regional Response Plans, or Area Contingency Plans. To respond effectively to the specific conditions presented during an oil spill, spill responders have used a variety of response optionsâ€"including mechanical recovery of oil using skimmers and booms, in situ burning of oil, monitored natural attenuation of oil, and dispersion of oil by chemical dispersants. Because each response method has advantages and disadvantages, it is important to understand specific scenarios where a net benefit may be achieved by using a particular tool or combination of tools. This report builds on two previous National Research Council reports on dispersant use to provide a current understanding of the state of science and to inform future marine oil spill response operations. The response to the 2010 Deepwater Horizon spill included an unprecedented use of dispersants via both surface application and subsea injection. The magnitude of the spill stimulated interest and funding for research on oil spill response, and dispersant use in particular. This study assesses the effects and efficacy of dispersants as an oil spill response tool and evaluates trade-offs associated with dispersant use.
